UK: Sharia court orders woman to return to abusive, rapist husband

UK: Sharia court orders woman to return to abusive, rapist husband, Jihad Watch

SHARIA courts are sentencing women to lives of misery by ordering them to stay with abusive husbands, a rape victim has claimed.

Where is the power of Western principles of human rights and a democratic constitution in Britain? This is what the Prime Minister of the UK, Theresa May, has defended in the name of religious freedom and diversity: she hailed the “great benefits” to Britain of sharia teachings, overlooking the principles of sharia, which permits men to beat and rape their wives. Add to that the shocking coverup of the abuse and brutalization of up to a million British girls at the hands of Muslim rape gangs. With its two-tier legal system, Britain is descending further into the pit of subjugation.

sharia-court

“Sharia court told rape victim to RETURN to her attacker husband,” by Leda Reynolds, UK Express, November 14, 2016:

The mother-of-two, calling herself Lubna, revealed that she had been beaten, robbed and raped by her estranged husband despite being the British courts banning him from approaching her and which had also awarded her custody of their children.

But family pressure persuaded the British-Pakistani to try and obtain an Islamic divorce in a Sharia court.

Expecting to be treated sympathetically, Lubna said she felt violated when she was instead told to return to her violent husband.

Gita Sahgal, a human rights activist from the One Law for All campaign and Centre for Secular Space, said this is the reality of Sharia courts which are operating across Britain.

She said many Muslim women are being denied their legal rights by Sharia courts which are bypassing the UK’s justice system and telling women British civil divorce does not count in the eyes of Islam.

She said: “Any woman who embarks on a new relationship will, they say, have committed adultery – a crime only equalled in their eyes by apostasy, abandoning Islam, and blasphemy.

“Yet the courts in, for example, Bangladesh and Pakistan, are perfectly happy to accept a civil divorce certificate from Britain as evidence of the end of a marriage, which in the Muslim tradition is a civil contract rather than a sacrament. In those countries, the contract must be registered to count as a legal marriage.”

The Commons Home Affairs Committee has begun an investigation into the spread of Islamic law, a move criticised by some Muslims who have branded the probe “interference”.

Dr Ahmad al-Dubayan, chairman of the UK Board of Sharia Councils – a body set up to standardise the administration of Islamic law – said unregulated Sharia law courts exist “everywhere in the country”.

And he told the Home Affairs Select Committee last week the self-appointed courts are performing marriages and handing out divorces.

Although the unregulated bodies have no legal force or jurisdiction in the UK, they are regularly used by Muslim families to adjudicate on personal matters, the Committee heard.

Many courts reportedly charge for their services, with fees for divorce proceedings often higher than British courts.

The doctor warned the exact number of Sharia courts operating across Britain is unknown.

He said: “We don’t know how many councils there are.

“Some people talk about 80 or 30 or 50, I don’t know. There is no record for this and no studies, unfortunately.”…..

The Select Committee heard that if Sharia courts are banned, backstreet courts will continue to operate but will slip even further under the radar.

Labour MP Naz Shah, who also giving evidence, admitted the councils could be used to “oppress” women.

She added: “Sharia itself is actually a code of conduct and the fundamental principal of Sharia is that the law of the land precedes anything.

“You cannot enforce and have a second parallel legal system in this country.

“As a British lawmaker I’m very clear, we have one law and that law is of the British court.”

An estimated 513,000 women and girls are at risk or have already been subjected to female genital mutilation in the United States, with the number skyrocketing due to increased immigration from countries in the Middle East and North Africa, where the practice is common.

The State Department considers female genital mutilation—the partial or total removal of female genitalia for no medical reason—to be a form of gender-based violence. The practice is illegal in the United States.

The number of girls suffering from female genital mutilation has tripled in the U.S. since 1990, according to a reportreleased by the Government Accountability Office on Monday.

The government places the blame on increased immigration from majority Muslim nations, where female genital mutilation is a common practice.

“The Centers for Disease Control and Prevention (CDC) estimated that 513,000 women and girls in the United States were at risk of or had been subjected to female genital mutilation/cutting (FGM/C) in 2012, a threefold increase from its 1990 estimate,” the Government Accountability Office said. “CDC attributes this change primarily to increased immigration from countries where FGM/C is practiced, rather than an increase in the occurrence of FGM/C. Agency estimates were not able to distinguish between those who have already been subjected to FGM/C and those who are at risk.”

The report also noted that there have been exceedingly few investigations into female genital mutilation in the United States, because it generally goes unreported.

“While [female genital mutilation/cutting] FGM/C is a crime under federal and many state laws, law enforcement officials identified few investigations and prosecutions related to FGM/C,” the report said. “Officials said that this may be due, in part, to underreporting.”

Immigrations and Customs Enforcement officials have had no criminal investigation into the practice, despite identifying “at least 25 individuals in immigration court proceedings who were suspected of assistance in the perpetration of” female genital mutilation.

“Of the 25 suspected perpetrators, officials were aware of 1 individual who was removed from the country in July 2005,” the report said. “The remaining 24 were granted relief or protection from removal, were still in immigration proceedings, or were not issued a travel document by their home country to implement the immigration court’s final order of removal.”

Over 200 million women and girls alive today have suffered from female genital mutilation around the world. The numbers are especially prevalent in North Africa, as women and girls have reported being subjected to female genital mutilation at alarming rates.

Ninety-eight percent of women and girls in Somalia said they have undergone female genital mutilation. Other countries with high rates of the practice included Guinea (97 percent), Mali (89 percent), Egypt (87 percent), and Sudan (87 percent).

The State Department has done little to invest in fighting the practice abroad despite its recognition of female genital mutilation as “gender-based violence.” A previous Government Accountability Office report revealed that the agency spent more trying to invent the “origami condom” than it did fighting female genital mutilation abroad.

The State Department has only one stand-alone effort specifically targeting female genital mutilation, spending just $1.5 million over two years.

The latest report echoed the findings, noting that the State Department does not provide information on the dangers of the practice to many immigrants. The Government Accountability Office said the State Department does not provide a fact sheet on female genital mutilation to nonimmigrant visa recipients, which includes tourists, foreign students, diplomats, and temporary workers entering the country.

“[Female genital mutilation/cutting] FGM/C has both immediate and long-term health and social consequences,” the report said. “While federal agencies have made efforts to provide assistance to women and girls in the United States at risk of or who have been subjected to FGM/C, and increase awareness of the issue, certain efforts to educate immigrant communities and plan agency activities on FGM/C are lacking.”

Germany’s New “No Means No” Rape Law

July 8, 2016

Germany’s New “No Means No” Rape Law, Gatestone InstituteSoeren Kern, July 8, 2016

♦ The reforms are unlikely to end Germany’s migrant rape epidemic.

♦ When it comes to immigration, political correctness often overrides the rule of law in Germany, where many migrants who commit sexual crimes are never brought to justice, and those who do stand trial receive lenient sentences from sympathetic judges.

♦”Every police officer knows he has to meet a particular political expectation. It is better to keep quiet [about migrant crime] to avoid problems.” — Rainer Wendt, head of the German police union.

♦ “It is unacceptable that asylum seekers are trampling on our society at the same time that they are here seeking our protection.” — Prosecutor Bastian Blaut.

The German parliament has approved changes to the criminal code that expand the definition of rape and make it easier to deport migrants who commit sex crimes.

Under the bill, also known as the “No Means No” (“Nein heißt Nein”) law, any form of non-consensual sex will now be punishable as a crime. Previously, only cases in which victims could show that they physically resisted their attackers were punishable under German law.

The changes, which were prompted by the sex attacks in Cologne, where hundreds of women were assaulted by mobs of mostly Muslim migrants on New Year’s Eve, is being hailed as a “paradigm shift” in German jurisprudence.

But the reforms, which are designed to make it easier for victims of sexual assault to file criminal complaints, are unlikely to end Germany’s migrant rape epidemic. This is because Germany’s politically correct justice system is notoriously lenient when it comes to prosecuting, sentencing and deporting foreign offenders.

1685

The bill was unanimously approved on July 7 by the Bundestag, the lower house of parliament. The measure must still be approved by the Bundesrat, the upper house, which will vote on the reforms after the summer recess.

According to the original law, as stipulated in Paragraph 177 of the Criminal Code, victims were required to prove that they had physically defended themselves for an act to constitute rape. Verbal communication — simply saying “No” — was insufficient to bring charges against an assailant. The original law was written that way to deter false accusations of rape and avoid frivolous lawsuits, according to German legal experts.

The reforms will allow prosecutors and courts to take into account physical, verbal and non-verbal signals from the victim when determining whether or not a rape occurred. Anyone convicted of sexual activity that goes against the “discernable will” (erkennbaren Willen) of the victim faces up to five years in prison. The law also broadens the definition of sexual assault to include groping, which is punishable by up to two years in prison.

Moreover, the new law introduces Paragraph 184j, which will make it crime just to be in a group that carries out sexual assaults. The measure is aimed to deter attacks such as those which occurred in Cologne, although some lawmakers say this provision is unconstitutional because a person could be convicted of a crime that he or she did not personally commit. Finally, the reforms make it easier to deport migrants who are convicted of sex crimes in Germany.

The German Minister for Women, Manuela Schwesig, hailed the measure as a milestone:

“In the past there were cases where women were raped but the perpetrators could not be punished. The change in the law will help increase the number of victims who choose to press charges, reduce the number of criminal prosecutions that are shelved and ensure sexual assaults are properly punished.”

According to Minister of Justice Heiko Maas, only one in 10 rapes in Germany is reported and just 8% of rape trials result in convictions.

Even if the new law results in an increase in the number of rape convictions, it is unlikely to be a meaningful deterrent for the migrants who are sexually assaulting German women and children.

When it comes to immigration, political correctness often overrides the rule of law in Germany, where many migrants who commit sexual crimes are never brought to justice, and those who do stand trial receive lenient sentences from sympathetic judges.

On June 30, for example, a court in the northern German town of Ahrensburg found a 17-year-old migrant from Eritrea guilty of attempting to rape an 18-year-old woman in the stairwell of a parking garage at the train station in Bad Oldesloe. The woman was seriously injured in the attack, in which the migrant tried to subdue her by repeatedly biting her in the face and neck. After police arrived, the migrant resisted arrest and head-butted a police officer, who was also sent to the hospital.

Despite finding the Eritrean guilty of sexually assaulting the woman and physically assaulting the police officer, the court gave him a seven-month suspended sentence and ordered him to do 30 hours of community service. He has been released from custody and will not be deported.

In addition to judicial leniency, migrant criminals have benefited from German authorities, who have repeatedly been accused of underreporting the true scale of the migrant crime problem in the country, apparently to avoid fueling anti-immigration sentiments.

In January, the newspaper Die Welt reported that the suppression of data about migrant criminality is a “Germany-wide phenomenon.” According to Rainer Wendt, the head of the German police union (Deutschen Polizeigewerkschaft, DPolG), “Every police officer knows he has to meet a particular political expectation. It is better to keep quiet [about migrant crime] to avoid problems.”

Also in January, a document leaked to the newspaper Bild revealed that politicians in the northern city of Kiel had ordered local police to overlook many of the crimes perpetrated by migrants. According to Bild, police in North Rhine-Westphalia and Lower Saxony have also been instructed to be lenient to criminal migrants.

In February, Die Welt reported that authorities in the German state of Hesse were suppressing information about migrant-related crimes, ostensibly due to a “lack of public interest.”

In May, a chief superintendent from the Cologne police department revealed that an official at the interior ministry in North-Rhine Westphalia ordered him to remove the term “rape” from an internal police report about the assaults in Cologne.

Police in Cologne now say they have received more than 1,000 complaints from women, including 454 reports of sexual assaults, related to New Year’s Eve. Police in Hamburg say they have received complaints from 351 women, including 218 reports of sexual assault that took place on the same evening.

On July 7, more than six months after the Cologne attacks (and the same day that the Bundestag approved the new “No Means No” rape law), a German court issued the first two convictions: The District Court of Cologne gave a 20-year-old Iraqi and a 26-year-old Algerian a one-year suspended sentence and then released the two men.

The court found the Iraqi, identified only as Hussain A., guilty of kissing one of the victims and licking her face. The Algerian, named as Hassan T., prevented the boyfriend of the other victim from intervening to stop the attack and offered him money to have sex with her: “Give the girls or you die,” he said. He was found guilty of being an accessory to sexual assault.

The Iraqi man, who was 20 at the time, was sentenced under juvenile law and was ordered to attend an integration course and do 80 hours of community service. The newspaper Bild published photographs of a jubilant Hassan T. smiling as he left the courtroom.

One observer said the light sentence was a mockery of justice and would serve as an invitation for criminal migrants to do as they please with German women.

Prosecutor Bastian Blaut said:

“It is unacceptable when basic values such as the equality of woman and man are violated. It is unacceptable that migrants are bargaining over women as in a bazaar. It is unacceptable that asylum seekers are trampling on our society at the same time that they are here seeking our protection.”

Obama and boy

Men need to “be better.”

—Michelle Obama in conversation with Oprah.

Western civilization is clearly coming part at the seams. There are so many destructive elements at work, they are almost impossible to list. But one of the most destructive of these elements, incited by a punitive feminist ideology, is the relentless campaign to delegitimize the very idea of manhood. And the most effective way to do that is to impugn male sexuality.

We are told constantly that we live in a virtual rape culture, a culture in which rape is widespread and condoned, victims are blamed, and rapists receive little or no punishment. There are rape cultures in the world. If one wants to see one in action, all one need do is look at the Muslim world or at Muslim enclaves and populations that have burrowed into Western nations, where atrocities and scandals continue to multiply. In the Western world, by contrast, rape and other forms of sexual misconduct—even mere allegations of sexual misconduct—are universally condemned and harshly punished.

No matter. Islamic culture gets a free pass while Western culture is said to be ravaged by gynophobia under the reign of male supremacism. In the new sexual paradigm that has clamped succubus-like upon the culture, the heterosexual male mainstream is under attack for the crime of harboring a normal sexual drive, which must be ruthlessly expunged in an offensive characterized by media propaganda, legislative bias and institutional practices. Respectable-seeming websites promote the total reform of masculinity using terms such as “mascupathy” to define masculine traits such as aggression and competitiveness as forms of disease needing to be cured. Western men are being progressively demasculanized, a deficiency which results, as Andrew Klavan argues, in “tremulous feminists who hysterically fear rape culture on college campuses where it is not, and Western leaders who don’t dare to see the rape culture inherent in invading Islam, where it is.”

The signs of anti-male bias are everywhere we look. The university, for example, has become a veritable minefield for male students, who may at any time be hauled before an administrative tribunal and their careers put in jeopardy for sexual misconduct, however trivial or ambiguous. A recent memo from my wife’s university mandates a statement against “sexual violence” in all course syllabi—mind you, nothing against harassing and lying about one’s professor for a better grade, shutting down conservative, Zionist, pro-Life or anti-feminist speakers, perpetrating racist hoaxes, denouncing the teaching of good English and male authors as forms of “microagression,” or any of the other violations of civil conduct that we have witnessed on university campuses recently. The only sexist harassment that takes place regularly in academia is feminist harassment of male students and staff—but that is considered not intimidation but enlightened practice.

Is it any wonder, then, that even our military is being insidiously weakened? Responding to a vehement attack on supposed martial dishonor by a former Supreme Court justice, it has turned from its primary task of defending the country to counseling its soldiers against what it regards as sexual delinquency by issuing wallet cards listing “inappropriate behaviors.” These include“sexual assault, sexual interference, sexual exploitation, offensive sexual remarks or unacceptable language or jokes, unwelcome requests of a sexual nature or verbal abuse of a sexual nature, voyeurism, indecent acts and publishing intimate images of a person without their consent.” The fact is, most men in the civilized West are not sexual predators or unreconstructed brutes but most men do tend to joke and flirt and make off-color remarks and otherwise show an interest in women, whether sexual or romantic, in virtue of being men. More to the point, if men are no longer permitted to be men, how then can they be soldiers?

When manliness is eliminated from a culture fixated on the supposedly corrupt and vicious nature of masculinity, while armies of apologetic White Knights and self-abnegating feminist allies (aka “manginas”) come to replace a diminishing platoon of alpha males—“We live in a world run by betas and their lady friends,” quips J.R. Dunn in a prescient article for American Thinker—the writing is on the wall. As Michael Ignatieff reminded us in The Lesser Evil, a culture, a nation or a civilization cannot expect to survive if it is defended by herbivores. It needs a Praetorian cohort of carnivores, determined men proud of their masculinity and unafraid to confront the enemies outside the gates as well as the fifth columnists, defeatists and appeasers within—i.e., politicians on both sides of the aisle, spineless university administrators, media abettors, tergiversating liberals, tenured academics who indoctrinate from the left rather than educate from the tradition of reputable scholarship, and the feminist Furies acting out their faux version of Lysistrata—if a culture is not only to survive but to flourish.

The feminist hordes in their anti-male animus, along with their Beta and Delta collaborators, have overrun a once-great and hardy civilization. As Klavan puts it, “The future goes where men go and does what men make it do. If men go down the drain, the future will follow.” The expression of male sexual desire in Western culture is hedged by rules of appropriate conduct and a code of chivalry, occasionally honored in the breach, yet relatively intact. But when male sexuality in its natural manifestations is regarded as an evil that must be controlled, reviled, prosecuted and ultimately bred out of men, societal collapse is inevitable. The irony is palpable. For a culture that targets men can neither defend nor reproduce itself and its days are numbered.

Orlando Shooting: Pickled in Hatred

June 13, 2016

Orlando Shooting: Pickled in Hatred, Gatestone InstituteShoshana Bryen, June 13, 2016

♦ The terrorists are pickled in hatred that simply does not allow for the humanity of “the other” and insists that individuals exist only as representations of religions, objects, and social or political points of view.

♦ The American homeland — free speech, religious institutions, open inquiry in academia, our military and our way of life — is under attack.

♦ America’s blessing is a political system built on tolerance of “the other.” Not all of us, not all the time — remember, we used to buy and sell our fellow human beings — but the principle to which we aspire is tolerance of “the other.”

♦ But our national blind spot is not seeing that we share this lovely space with people who want to kill us for the peculiar people we are.

It is a lot to process. Omar Mateen, the American-born son of Afghan parents, murdered 50 people and wounded scores of others in a gay nightclub Sunday. The first surprise is that it was not a surprise, especially to the FBI. Mateen was the subject of investigations in 2013 and 2014. “He was a known quantity,” a source said. “He has been on the radar before.” But Assistant Special Agent Ronald Hopper told reporters, “Those interviews turned out to be inconclusive, so there was nothing to keep the investigation going.”

Omar Mateen’s father probably wasn’t terribly surprised. He told NBC News “that his son became angry after seeing two men kissing a few months ago in Miami.” He speculated that could have triggered his decision to kill. “This has nothing to do with religion,” his father added.

President Obama was not exactly surprised, given, he said, the number of guns in America. He called again for gun control and said there was, “no definitive judgment on the precise motivations” of the terrorist.

Oh really?

President Obama’s response might have been a surprise to local police, who, according to CNN, received a 911 call from Mateen pledging his allegiance to ISIS just before the attack. Whether he was actually with ISIS or not, the Islamic State wasted no time blessing him as one of their own.

1647Omar Mateen (left), the American-born son of Afghan parents, murdered 50 people and wounded scores of others in a gay nightclub in Orlando, Florida, on May 12, 2016. Mateen pledged his allegiance to the Islamic State just before the attack.

So where do Americans go with this?

First, pray for the victims and their families, and thank the first responders.

Second, do not bother trying to “explain” terrorists, or figure out their “motivation.” They are pickled in hatred that simply does not allow for the humanity of “the other” and insists that individuals exist only as representations of religions, objects, and social or political points of view. There is no other way to explain Shalhevet Pass, a six-month old baby shot in her stroller by a sniper, or Malki Roth murdered while eating pizza, or the Fogel children murdered in their beds. There is also no other way to explain shootings at Max Brenner in Tel Aviv or stabbings in Jerusalem; Hamas rockets fired indiscriminately into Israeli towns; gay men thrown off buildings by ISIS in Iraq or dragged behind motorcycles in Gaza; barrel bombs and chlorine gas dropped on civilians by Assad’s Syrian forces; the kidnapping and forcible conversion to Islam of girls by Boko Haram; the sale of Yazidi women and girls as sex slaves by ISIS; and the skinning alive of prisoners by the Taliban. They are all of a piece.

Third, recognize that the same hatreds exist in our country. We imported them — already pickled — and we pickled some of them here. What Mateen’s father said was that seeing what he found unacceptable — men kissing — was enough to make his son kill. Maybe. Maybe not. Either way, what do we need to do about people willing to kill us under those circumstances?

The Heritage Foundation maintains an extremely useful timeline of terrorist plots in the US. It includes the “shoe bomber” (2002), the “underwear bomber” (2010), the Times Square bomber (2010), the Boston Marathon bombers (2013), and the San Bernardino shooters (2015). But there’s more. Here is sampling from a Jewish Policy Center analysis:

[T]here were also plots against U.S. landmarks and institutions including the NY Subway system (2005 & 09), Sears Tower (2006), the Brooklyn Bridge (2003), the Long Island Railroad (2009), DC Metro (2010), the Federal Reserve in Manhattan (2012), the Capitol (2011, 12 & 15), World Bank Headquarters (2005), JFK airport (2009), the NY Stock Exchange (2004), and the GOP convention (2004).There were plots against American service personnel, including military hit lists (2010 & 15); Ft. Hood (2009); Ft. Riley (2015); Ft. Dix (2007) and Ft. Myers (2011); recruiting stations in Arkansas (2009), Maryland (2011) and Washington (2011); the Pentagon (2011); Quantico Marine Base (2009); National Guard facilities (2005, 08 & 09); U.S. Marshals (2013); and the NYPD (2015). There were plots against the ambassadors of Saudi Arabia (2011) and Pakistan (2004), and the Israeli Embassy (2011).

There were assassination plots against Presidents Bush (2003) and Obama (2011).

There were regional attacks planned for a Chicago Bar (2012), NY and Chicago-area synagogues (2009 & 10), an Oregon Christmas tree ceremony (2010), the Wichita Airport (2014), a Canada-NY train (2013), a Dallas skyscraper (2009), a Wyoming refinery (2006), the Florida Keys (2015), shopping centers in Ohio (2003) and Illinois (2007), and the University of North Carolina (2006). The Lackawanna (PA) Six (2002), the Lodi (CA) jihad training camp (2005), and the VA Jihad Network (2003) operated along with smaller-scale plots in support of al Qaeda (2002, 09 & 10).

The American homeland — free speech, religious institutions, open inquiry in academia, our military and our way of life — is under attack.

America’s blessing is a political system built on tolerance of “the other.” Not all of us, not all the time — remember that we used to buy and sell our fellow human beings — but the principle to which we aspire is tolerance of “the other.” America’s glory is men and women who run into danger while everyone else is running out — without regard for the particulars of who they are saving. It was true on 9-11 and it was true this weekend in Orlando. But our national blind spot is not seeing that we share this lovely space with people who want to kill us for the peculiar people we are.

Polygamy: Europe’s Hidden Statistic

June 5, 2016

Polygamy: Europe’s Hidden Statistic, Gatestone InstituteJudith Bergman, June 5, 2016

♦ The sheer volume of polygamous marriages shows that such marriages are also entered into in Europe, in secret, through Islamic marriage ceremonies conducted by imams. In most European countries, imams are not required to report these marriages to the authorities.

♦ Daham Al Hasan fled from Syria to Denmark, leaving behind his three wives and 20 children. Under the Danish rules of family unification, one of his wives and eight of his children have joined him in Denmark. But Al Hasan wants all his children with him, as well as all his wives. Lawyers estimate that the remaining wives will be able to join their children in Denmark. The case has caused a shock not only because of what it will cost the Danish state just in child allowance, but because Al Hassan claims that he is too ill to work or even learn Danish. “I don’t only have mental problems, but also physical problems…” He has admitted that his “mental illness” consists of missing the children he voluntarily left behind.

♦ Even if theoretically women can go to the police or press charges, they run the risk of being beaten or possibly divorced. Women’s shelters are “full of Muslim women.”

♦ The spokeswoman of Germany’s Federal Employment Agency said that the establishment of a central registry of Islamic marriages would be helpful for investigating claims of fraud.

A few years ago, Sweden’s Center Party, one of the four parties in the center-right governing coalition at the time, proposed legalizing polygamy. The idea caused outrage; the proposal was dropped. The party’s youth division, however, refused to let go: “We think it is important for the individual to decide how many people he or she wants to marry,” said Hanna Wagenius, head of Center Youth, predicting that polygamy would be legal in ten years, when her generation would enter parliament and make sure of it.

Sweden is not the only place in Scandinavia where “idealistic” youths have advocated polygamy. In 2012, the youth division of Denmark’s Radikale Venstre Party (“Radical Left”), then part of the governing coalition in Denmark, also proposed that polygamy should be legalized in Denmark. The move came four years after an Iraqi asylum seeker, who had worked for the Danish military in Iraq as a translator and then fled to Denmark, arrived with two wives. As Denmark does not recognize bigamy and as he refused to divorce his second wife, he returned to Iraq. “It is unacceptable that we are so narrow-minded in Denmark, and will not help a man who has helped us. We want to do something about that,” Ditte Søndergaard, head of Radikale Venstre Youth, said at the time. The proposal, however, did not find favor with any of the other political parties.

As far-fetched as these proposals may sound, they signify the shifts taking place in the West regarding fundamental ethical issues of gender equality and the willingness to accommodate Islamic sharia law. They are also proof of an enduring willful blindness to the detrimental effects of the practice of polygamy, not only in terms of financial costs to the state, but also to the Muslim women and children, whose rights these young politicians purport to support.

Muslim polygamy is only rarely debated in the media. The practice, therefore, despite its spread across the European continent — spanning, among other countries, Sweden, Denmark, the UK, Germany, France and the Netherlands — continues largely to hide under the public radar. As the practice is illegal across the continent and therefore not supposed to exist, there are no official statistics of polygamous marriages anywhere in Europe.

Several countries, such as the UK, the Netherlands, Sweden and France, nevertheless recognize Muslim polygamous marriages if they were contracted abroad under certain circumstances, such as if polygamy is legal in the country where the marriage took place. It is estimated that as many as 20,000 polygamous Muslim marriages exist in Britain. In France, as polygamy was legal until 1993, the minimum estimate as early as 2006 was around 20,000 polygamous marriages. In Germany, it was estimated in 2012 that, in Berlin alone, 30% of all Arab men were married to more than one wife.

In April, Swedish professor Göran Lind argued that it was time to “put one’s foot down” regarding polygamy in Sweden, after it was disclosed that Sweden had recognized “hundreds” of polygamous marriages contracted abroad. Professor Lind pointed out that polygamy is not compatible with Swedish law, especially the principles of equal treatment of spouses, the equality of all human beings, and the prohibition against discrimination on the basis of gender, as codified in the European Convention on Human Rights. One might add to those the principles enshrined in the UN’s Convention on the Elimination of All Discrimination Against Women, article 16, according to which,

“States Parties shall take all appropriate measures to eliminate discrimination against women in all matters relating to marriage and family relations and in particular shall ensure, on a basis of equality of men and women:

“(a) The same right to enter into marriage;

“(b) The same right freely to choose a spouse and to enter into marriage only with their free and full consent.”

Considering how much time leading European politicians spend on assuring their electorates of their dedication to human rights, their tacit acceptance of these glaring violations of women’s rights, as enshrined in the above conventions, which polygamy constitutes, is rather peculiar.

The sheer volume of polygamous marriages, however, attests to the fact that such marriages are also entered into in Europe, in secret, through Islamic marriage ceremonies conducted by imams. In most European countries, imams are not required to report these marriages to the authorities. Therefore, despite the probable knowledge of the authorities, this illegal practice is basically allowed to flourish unhindered. As Islamic marriage does not legally exist in Europe, the woman entering into the union is left legally stranded and vulnerable with no means — other than the local imam or sharia council — of getting out of the marriage. Even if women can theoretically go to the police or press charges, they run the risk of being beaten or possibly divorced. Women’s shelters are “full of Muslim women,” as Ayaan Hirsi Ali, who worked in them, attests.

Polygamous Muslim marriages are bound to become an even bigger problem in the wake of the migrant crisis.

In Denmark these days, Daham Al Hasan is making headlines. He has twenty children with three wives, but two years ago fled alone from Syria to Denmark, and left his wives and children behind. Recently, under the Danish rules of family unification, one of his wives and eight of his children have joined him in Denmark. But Al Hasan wants all his children with him, as well as all his wives. He has been granted permission for nine additional children to join him, but as Denmark does not allow polygamy, the two remaining wives, under the same rules of family unification, are not permitted to join him. Lawyers, however, estimate that the remaining wives will also be able independently to join their children in Denmark, once they are there.

The case has caused rather a shock in Denmark, not only because of the extraordinary size of the family, and what it will cost the Danish state just in child allowance, but because Al Hassan claims that he is too ill to work or even to learn Danish. “I don’t only have mental problems, but also physical problems”, he says by way of explanation, “My back and my legs hurt.” He has admitted that his “mental illness” consists of missing the children he voluntarily left behind. This means that he and his family live exclusively off the Danish taxpayers’ money.

What is noteworthy about the current debate, however, is what is not being debated: namely that Al Hassan is a polygamist. While it is only natural that politicians and citizens feel violated and aggrieved about the financial costs to the Danish state, they should be equally concerned about the practice of polygamy. Yet not a single Danish feminist has spoken out about it.

In the television documentary, “Sharia in Denmark”, several imams recorded on a secret camera answered in the affirmative and without the least hesitation the question of whether a woman’s husband was allowed to take another wife against his first wife’s wish. For them, in fact, despite the fact that they live in a country where bigamy and polygamy are prohibited, for a man to take a second, third or fourth wife regardless of what any of them thought, seemed perfectly natural.

A qualitative study about Muslim women in Denmark from 2009, performed by Tina Magaard for the Danish Ministry of Welfare, documented the practice of polygamy among Danish Muslims. One Turkish woman told the interviewers:

“A growing group of women marries a man who is already married. They get married by an imam because then they become more accepted. Apparently, they have no alternative. They become ostracized if they were divorced and are on their own. Many would rather live a life where they get an identity — then they belong somewhere and then they are accepted. And it is sad that it exists in Denmark. I think if they could count the numbers, which is very difficult, they are probably much higher than we think.”

Another woman, a Muslim convert, said:

“This [polygamy] is something that I have really seen a lot of, there was a period when it became fashionable. I think it was five or six years ago, it was crazy, I think almost every second couple I knew, the man got himself an extra wife. But then, after a year or so, he regretted it or he divorced the first wife. I actually think there were twelve from my circle of friends where the husband got himself another wife.”

In a German documentary from 2013, the journalists found that Muslim men used polygamy as a means to commit fraud and obtain more welfare benefits. The tactic was to have their wives claim at the Employment Center that they were single women who did not know the father of their children. The story works because Germany, like other European countries, has no way of ascertaining the existence of an Islamic marriage, especially as German law does not obligate women to inform the authorities of their marital status.

In the film, the journalists asked the spokeswoman of the Federal Employment Agency — the supervisor of the local Employment Agencies responsible for paying out welfare benefits — whether the Federal Employment Agency was aware of the many instances of fraud. The woman said that they were indeed aware of the polygamy and the ensuing fraud and even enumerated the places where it was rife: large cities in Western Germany, such as Berlin, Cologne and Frankfurt. The journalist then asked the woman why nothing was being done about it. “I believe these cultural differences are very sensitive, we are a very tolerant country,” the woman said. Asked whether the Federal Employment Agency was perhaps too tolerant, the woman said that indeed she herself was wondering how it will all end.

The woman then said that the establishment of a central registry of Islamic marriages would be most helpful and desirable, as it would make possible investigating claims of fraud; but that this was a matter for the politicians.

“How will it all end?” Not well.

It’s important to remember that the Cologne sexual assaults took place outside its cathedral.

In a crowd of 1,000 men, hundreds of Muslim refugees prowled, assaulting and robbing any woman they could find. A police officer described seeing crying women stumble toward him after midnight. He managed to rescue one woman whose clothes had been torn off her body from a group of her attackers, but could not save her friends because the mob had begun hurling fireworks at him.

The provost of the Cologne Cathedral had warned anti-Islamist protesters, “You’re supporting people you really don’t want to support.” But it was the provost and pro-refugee activists who had supported people they really didn’t want to support. There is no way to know whether any of the smiling young people holding, “I Love Immigration” banners had fallen victim to those refugees they loved so much.

And the cathedral itself came under attack.

Barbara Schock-Werner, who served as cathedral architect between 1999 and 2012, was present at the well-attended religious service along with several thousand other worshippers. Shock-Werner told the German newspaper, Frankfurter Allgemeine, that the cathedral experienced an unprecedented and massive rocket and ‘banger’ fireworks barrage that lasted the whole service.

“Again and again the north window of the cathedral was lit up red, because rocket after rocket flew against it,” she said. “And because of the ‘bangers’, it was very loud. The visitors to the service sitting on the north side had difficulties hearing. I feared at times that panic would break out.”

Cardinal Rainer Woelki, who presided at the New Year’s mass, also complained about the “massive disruptions.”

“During my sermon loud ‘bangers’ could be heard,” Woelki said in the paper, Die Welt. “I was already annoyed beforehand about the loud noises that were penetrating into the cathedral.”

But Woelki is attacking anti-Islamists.

Rainer Woelki posted a video where he ridiculed the right-wing party’s claim that Islam is incompatible with the German constitution. The archbishop’s intervention comes after the anti-immigration party said it would press for bans on minarets and burqas.

“Anyone who denigrates Muslims as the AfD leadership does should realise prayer rooms and mosques are equally protected by our constitution as our churches and chapels,” he said.

“Whoever says ‘yes’ to church towers must also say ‘yes’ to minarets.”

And then they have to say “yes” to sexual assaults and “no” to women walking the streets.
