[B]ecause the Obama administration has scuttled the ongoing prosecution of CAIR, the group is now free to intervene in terrorism cases and effectively dictate the terms of the FBI’s terrorism investigations.

If you are a member of the media or even an investigator with the FBI seeking to question members of the Orlando terrorist’s family or mosque, you will now have to go through a federally listed terrorist front group — the Council on American-Islamic Relations.

Calls to Omar Mateen’s father and other relatives are now redirected to a phone number for a CAIR attorney, and another CAIR lawyer is sitting in on FBI interviews with suspects at Mateen’s radical mosque in Fort Pierce, Fla. — even though the FBI has suspended formal ties to CAIR over the group’s association with terrorist groups.

CAIR lawyered up a suspect who was interviewed by two FBI agents at the mosque for about 30 minutes on Friday. The CAIR lawyer, Omar Saleh, also happens to be a longstanding member of that same mosque — the Islamic Center of Fort Pierce — as well as a friend of the Mateen family. Mateen’s sisters, who work at the mosque and own property on the same street, follow local CAIR coordinators on social media.

The small Islamic center has now graduated two deadly terrorists in the past two years, including a worshiper who became the first American suicide bomber in Syria. Local law enforcement authorities call it “a breeding ground” for terrorists.

Saleh, who isn’t charging mosque suspects for his legal help, is now in charge of fielding questions from investigators interested in questioning other suspects in the June 12 terrorist attack. In fact, CAIR is now offering free legal aid to the entire Muslim community in which Mateen lived.

What’s more, CAIR’s legal counsel and communications director for its Florida chapter is acting as the official spokesman for the Islamic Center of Fort Pierce. The CAIR official, Wilfredo Amr Ruiz, has minimized Mateen’s involvement in the mosque, claiming he was a fringe member who was quiet and kept to himself.

“He was very unusual,” Ruiz told the local press. “After Friday noon prayers, the older people stay and socialize. He did so very few times.”

CAIR’s Saleh agreed: “He was just a person who came in and out. Most people didn’t know him at all … There’s no way anyone would know” he sought to carry out violent jihad against fellow Americans.

But that doesn’t square with accounts from co-workers and classmates who describe Mateen as an opinionated loudmouth with violently anti-American and homophobic views. And Mateen was hardly on the fringes of the mosque community. As CounterJihad.com first reported, mosque records show his father helped lead the Islamic center as a top officer and board member.

Ruiz, who’s also worked for a Florida-based Islamist group that demonizes homosexuals, additionally claimed Mateen’s attendance at the mosque was “sporadic,” even though others said he regularly prayed there three to four times a week for the past 13 years. In fact, he was seen praying at the Islamic center the night before the attack one gay nightclub in Orlando.

Running interference in terrorism investigations is a familiar pattern for CAIR, which remains on a federal terrorist co-conspirators blacklist.

Last year, CAIR intervened on behalf of the family and mosque of the San Bernardino terrorists, even holding a press conference for family members to help spin their story before investigators had a chance to talk to them. Within hours of the attack, CAIR swooped in and lawyered up key witnesses and suspected co-conspirators in the plot, including relatives and friends of the shooters along with leaders of their mosque.

CAIR officials defended the parents of the lead shooter even as they were placed on a federal terrorist watchlist.

“Those family members would have been key (persons of interest) for those FBI agents and other law enforcement agencies to interview after the immediate fact, to try to find out what the motives were and why this attack took place,” former FBI agent Chad Jenkins said at the time. “Instead, they’re doing public appearances with that organization.”

CAIR officials characterized the San Bernardino terrorist attack as “workplace violence,” adding “This is not a Muslim problem.”

After it became clear that the attack was Islamic jihad, the CAIR official who organized the press conference — Hussam Ayloush of Los Angeles — claimed America was “partly responsible” because of its support of “oppressive regimes around the world that push people over on the edge.”

In a lesser known case, CAIR actually coached a Muslim leader of a Maryland mosque on how to mislead FBI agents interviewing him about suspicious activity related to terrorism at the mosque. The 2004 case was detailed in the book, “Muslim Mafia,” citing internal CAIR records marked “DO NOT RELEASE OUTSIDE CAIR.” As a result of CAIR’s obstruction, the witness withheld critical information from the agents, who were attached to the bureau’s Pittsburgh field office.

Though CAIR publicly claims to cooperate with law enforcement, it privately advises the Muslim community to clam up when FBI agents ask questions — and to even slam the door in their face. In 2011, a California chapter of CAIR distributed a poster to area Muslims advising them to “Build a Wall of Resistance; Don’t Talk to the FBI.” An accompanying graphic showed homeowners slamming the door on federal agents, who were depicted as evil spies.

The FBI says it will no longer conduct outreach with CAIR until “we can resolve whether there continues to be a connection between CAIR or its executives and HAMAS,” a U.S.-designated terrorist group. In 2007, the Justice Department implicated CAIR and one of its co-founders in a Hamas fund-raising case. The courts have denied CAIR’s repeated motions for removal from the federal unindicted co-conspirators list.

When CAIR demanded the U.S. Justice Department remove it from the list, a federal judge wrote in an unsealed ruling: “The government has produced ample evidence to establish the associations of CAIR … with Hamas.”  The case was sent to an appellate court which ruled unanimously to keep CAIR on the co-conspirator list because of the overwhelming evidence against it.

Washington-based CAIR is not “an appropriate liaison partner” for the FBI because of evidence linking the organization and its leaders to Hamas, an FBI assistant director said in a letter to the U.S. Senate.

“In light of that evidence, the FBI suspended all formal contacts between CAIR and the FBI,” Richard C. Powers, an assistant director in the FBI’s Office of Congressional Affairs, explained in the letter.

Yet because the Obama administration has scuttled the ongoing prosecution of CAIR, the group is now free to intervene in terrorism cases and effectively dictate the terms of the FBI’s terrorism investigations.

The Justice Department on Monday afternoon released the full, unredacted transcript of a call between Orlando terrorist Omar Mateen and 911 operators on the night of the mass shooting after an earlier version of the transcript omitted the words “Islamic State” and the name of ISIS leader Abu Bakr al-Baghdadi.

The Justice Department made the decision to release the complete transcript after public pressure from Republican leaders and a number of media organizations.

Mateen, who killed 49 people and wounded 53 others on June 12 at a gay nightclub in Orlando, made a 50 second call to 911 at about 2:35 a.m. during the massacre. He pledged allegiance to ISIS leader Abu Bakr al-Baghdadi during the call.

“I pledge allegiance to Abu Bakr al-Baghdadi may God protect him [in Arabic], on behalf of the Islamic State,” the unredacted transcript reads.

The original FBI release said, “I pledge allegiance to [omitted] may God protect him [in Arabic], on behalf of [omitted].”

The old version also described three crisis calls made the night of the shooting that showed Mateen told a negotiator to stop bombing Iraq and Syria, a reference to efforts by a U.S.-led coalition to defeat ISIS’s core in both countries.

“There is some vehicle outside that has some bombs, just to let you know. You people are going to die, and I’m gonna ignite it if they try to do anything stupid,” Mateen told authorities, according to the transcript.

House Speaker Paul Ryan (R., Wis.) said the decision by the FBI and Justice Department to redact Mateen’s pledge to ISIS was “preposterous.”

“We know the shooter was a radical Islamist extremist inspired by ISIS,” Ryan said in a statement. “We also know he intentionally targeted the LGBT community. The administration should release the full, unredacted transcript so the public is clear-eyed about who did this, and why.”

The Justice Department called the uproar about the omissions in the original transcript “an unnecessary distraction” before reversing course and directing the FBI to release the complete version.

“Unfortunately, the unreleased portions of the transcript that named the terrorist organizations and leaders have caused an unnecessary distraction from the hard work that the FBI and our law enforcement partners have been doing to investigate this heinous crime,” both organizations said in a statement.

Attorney General Loretta Lynch had told NBC’s Chuck Todd on Sunday, “What we’re not going to do is further proclaim this man’s pledges of allegiance to terrorist groups, and further his propaganda. We are not going to hear him make his assertions of allegiance [to ISIS].”

The Orlando massacre has turned into a heated debate in Washington about how to appropriately respond.

Most Republican lawmakers have argued that the terrorist attack proves greater urgency is needed to defeat ISIS and enhance counterterrorism efforts. Democrats have pressed for gun control legislation in response to the shooting and are calling it a hate crime targeting the LGBT community.

In addition to FBI Director Comey’s “confusion” as to the Orlando jihadi’s motives, Comey explained why the FBI dropped the investigation into jihad mass murderer Omar Mateen (not once but twice). Mateen had claimed to be aligned with Islamic terrorist groups and threatened coworkers. When the FBI questioned Mateen, he claimed his coworkers were picking on him “because he was Muslim.” The case was dropped.

FOX 59: Additionally, the FBI said they investigated Mateen for 10 months beginning in May 2013 after  he made “inflammatory and contradictory statements” to co-workers. The FBI interviewed him twice.

He admitted to making the comments but said it was because his co-workers were racist and making fun of him because he was Muslim. (FOX News)

Omar Mir Seddique Mateen, a US Muslim citizen aged 29, son of Afghan migrants, perpetrated the deadliest shooting attack in American history on June 12, when he massacred 50 people and injured 53 at the Pulse gay club in Orlando, Florida, with an AR 15 assault rifle and a Glock 17 handgun.

The guns were purchased legally a few days earlier at a local shop. This alone ought to have alerted the various US intelligence and surveillance agencies responsible for countering terrorism – except that, for lack of coordination, they missed the fact that a man twice questioned by the FBI was suddenly loading up on deadly weapons.

Mateen fit the profile of an Islamic terrorist, whose attributes the incumbent US administration consistently refuses to acknowledge: He was a Muslim, whose Afghan immigrant father is a Taliban supporter; a religious extremist, who recently made the pilgrimage to Mecca; he was divorced, known for violence, and licensed as a security officer to carry a gun.

The Orlando killer had long been overdue for close monitoring – or least a flag to prevent him from working as a security officer or carrying arms.

In 2013-14, the FBI interviewed him after he made “inflammatory remarks” to a colleague, before closing its investigation.

In 2014, the FBI hauled him in again over a connection with Mohammad Abu-Salha, a 22-year old Palestinian American. They had grown up together at the small Florida coastal town of Fort Pierce. Abu Salha went off to Syria, joined the al Qaeda-linked Nusra Front and killed himself in a suicide attack by driving a massive truck bomb into a restaurant filled with Syrian government soldiers.

Yet the FBI against closed the file on Mateen after determining that the links between the two young Muslims did not warrant a full-dress inquiry.

Compiling all the known data on the Orlando killer with the results of the FBI interviews with him would have placed him high on the list of suspects and called in for further questioning.

The oversights of US law enforcement, intelligence and security agencies recur each time Islamists terrorist strike. The Ramadan 2016 attack in Orlando showed that no lessons had been learned from the lapses that led to 9/11.

The FBI erred gravely in closing the case over the Mateen connection with the Palestinian American suicide bomber. This explains why senior FBI officials are down-playing the importance of that connection.

When he was exculpated, the federal authorities also discontinued electronic surveillance of the terrorist’s movements. So they missed his mounting extremism, his frequent attendance at a mosque led by a radical imam, who regularly incited his flock to murder (“Gays must die”). He thus kept his Security Officer’s ID which gave him access to secure government sites. His name was kept on the list of licensees for carrying firearms.

It is especially hard to understand the lackadaisical handling by federal agents of this prime suspect when the FBI Director James Comey was reiterating: “The Islamic State remains the top threat America is facing.”

Before entering the Pulse night club with the intent to slaughter those partying inside, Mateen called 911 and swore allegiance to the leader of the ‘Islamic State’ Abu Bakr al-Baghdadi, and recalled Tamerlan and Dzhokhar, the brothers responsible for the 2013 Boston Marathon terror attack.

For 20 minutes, the dispatchers did not understanding what he was saying and lost the chance to triangulate his cellular phone’s location and send police to nab him.

At the door of the club, he got into a brief exchange of fire with policeman before going in. Mateen went from room to room, firing well aimed semi-automatic rounds, killing tens of people, wounding tens more, and rounding up 30 people as hostages. He knew enough from his experience as a security guard to lock them in the restrooms which had no windows.

Long before the police, the city hall or any other official entity came to their senses, the club’s management sent a message via social networks: ‘Everyone get out of pulse and keep running.’

For three precious hours, dozens of police cars and ambulances, with FBI agents, dog handlers, special bomb disposal units, and other security officials huddled outside the club without doing anything. During these hours only a few shots sounded and many of those wounded lost their lives from blood loss and lack of medical treatment.

Only at 5 am, did the special anti-terror unit enter the scene, with one team using small detonators and firing at the terrorist to distract him while a force of 9 officers blew up the opposite wall and broke a hole through which officers could enter, fire and kill the terrorist. This entire event took 4 minutes.

Despite the three-hour wait, not enough ambulances had reached the scene, and some of the casualties had to be driven in civilian vehicles.

Mateen committed his murderous assault on the 300 partygoers at the Pulse club with ease, due to a number of factors:

  1. US law enforcement agencies have shown inexplicable tolerance toward Islamist extremists to the point that the Orlando killer was free to purchase an unlimited amount of deadly weapons.
  2. Due to lack of coordination between intelligence and law enforcement agencies, this killer was able to gain employment with a firm that trains its personnel in the use of firearms.
  3. As soon as the local police were alerted to gunfire at the door of the club, they should have swarmed in to neutralize the killer. The three-hour wait for the SWAT team’s arrival betokened weakness and an unwillingness to fight, so leaving the horrendous event in the hands of the terrorist.
  4. Pinning the dreadful episode on lack of gun control avoids the issue. Terrorists will always find murder weapons – if not guns, then homemade bombs like the Boston Marathon brothers, kitchen knives or vehicles. Even in countries with strict gun control, there is always a black market.

In a surprising discovery, the Palm Beach Post first reported that according to state records, Orlando shooter Omar Mateen – who as we reported earlier was licensed as a security guard and also holds a firearms license – was employed by the US subsidiary of G4S plc, a British multinational security services company, whose US-headquarters are located in Jupiter, Fla, and which also happens to be the world’s largest security company by revenue.

Shortly thereafter, G4S confirmed that Omar Mateen has worked for the company since 2007. This is the statement released from G4S:

 “We are shocked and saddened by the tragic event that occurred at the Orlando nightclub. We can confirm that Omar Mateen had been employed with G4S since September 10, 2007. We are cooperating fully with all law enforcement authorities, including the FBI, as they conduct their investigation. Our thoughts and prayers are with all of the friends, families and people affected by this unspeakable tragedy.”

In other words, Mateen who according to preliminary reports, had been on a terrorist watchlist, and who still managed to obtain weapons thanks to his various licenses and permits just last week, was employed by one of the world’s largest security companies, where he may have had extensive clearances well above his pay grade, not to mention access to sophisticated military weapons and equipment.

But where it gets more disturbing is that as Judicial Watch reported several days ago, in a post titled, “DHS Quietly Moving, Releasing Vanloads Of Illegal Aliens Away From Border“, border patrol sources said that the Department of Homeland Security (DHS) was quietly transporting illegal immigrants from the Mexican border to Phoenix and releasing them without proper processing or issuing court appearance documents. As a reminder, the government classifies them as Other Than Mexican (OTM) and this week around 35 were transferred 116 miles north from Tucson to a Phoenix bus station where they went their separate way. Judicial Watch was present when one of the white vans carrying a group of OTMs arrived at the Phoenix Greyhound station on Buckeye Road.

And this is where the Mateen-G4S link emerges: as JW reported previously, a security company contracted by the U.S. government is driving the OTMs from the Border Patrol’s Tucson Sector where they were in custody to Phoenix, sources said. The firm is the abovementioned G4S, the world’s leading security solutions group with operations in more than 100 countries and 610,000 employees. G4S has more than 50,000 employees in the U.S. and its domestic headquarters is in Jupiter, Florida.

Judicial Watch noted that it had filed a number of public records requests to get more information involving the arrangement between G4S and the government, specifically the transport of illegal immigrants from the Mexican border to other parts of the country. The photo below shows the uniformed G4S guard that transported the OTMs this week from Tucson to Phoenix.

Outraged Border Patrol agents and supervisors on the front lines say illegal immigrants are being released in droves because there’s no room to keep them in detention. “They’re telling us to put them on a bus and let them go,” said one law enforcement official in Arizona. “Just move those bodies across the country.” Officially, DHS denies this is occurring and in fact earlier this year U.S. Customs and Border Protection Commissioner R. Gil Kerlikowske blasted Border Patrol union officials for denouncing this dangerous catch-and-release policy. Kerlikowske’s scolding came in response to the congressional testimony of Bandon Judd, chief of the National Border Patrol Council, the labor union that represents line agents. Judd told lawmakers on the House Judiciary Committee that illegal immigrants without serious criminal convictions can be released immediately and disappear into the shadows. Kerlikowske shot back, telling a separate congressional committee: “I would not stand by if the Border Patrol was — releasing people without going through all of the formalities.

Meanwhile, the Hill reported that Mateen’s employment, and gun licenses, were untouched even though the FBI confirmed it had interviewed the 29-year-old three times before the shooting took place early Sunday morning.  An official said that the FBI first became aware of the suspect, Omar Mateen, 29, in 2013 when he made “inflammatory comments to coworkers alleging possible terrorist ties.”

 In the course of that investigation, Mateen was interviewed twice, but the FBI was unable to verify the substance of his comments.

Then, one year later, in 2014 the FBI conducted an investigation into possible ties between Mateen and an American suicide bomber. The FBI conducted another investigation, which included an interview with Mateen, but determined that the contact did not constitute a threat at that time. Which may be an overstatement: the FBI’s 2014 probe allegedly found that the  Orlando shooter had “minimal” contact with Florida al-Nusra fighter Moner Abusalha who blew himself up in Syria.

In 2015, after Moner Abusalha became the first American suicide bomber in Syria, the FBI investigated Omar Mateen’s connection to Abu-Salha. Abu-Salha went to the Middle East, trained, and returned to the Treasure Coast, specifically Vero and fort Pierce, to recruit. The FBI says he didn’t recruit anyone, but it’s possible he did have contact with Mateen.

The FBI said it is looking into any and all connections, both domestic and international to the shooting. It appears to have found nothing despite it all being laid out in front of its face.

The agent at Sunday afternoon’s press briefing also confirmed reports that the shooter called 911 before the massacre, and said his remarks had general connections to the Islamic State of Iraq and Syria (ISIS) terror group. The content of those calls is now federal evidence.

It gets even more bizarre: despite his chequered history and his numerous FBI encounters, the Orlando Police just reported that he had managed to purchase firearms in just this past week.

A Bureau of Alcohol, Tobacco, Firearms and Explosives spokesperson confirmed that Mateen legally purchased 2 firearms — a handgun and a long gun, “within the past few days.”

Armed with all this information, the big question, now that it has emerged that Mateen worked for the same company that has been tasked – under questionable circumstances – to transport illegals into the US, is whether or not this individual who swore allegiance to ISIS moments before the worst mass shooting and who was also employed by G4S for almost a decade, and who had been interviewed by the FBI three times and yet still managed to buy guns just last week, was also tasked in any way in facilitating the transport of illegal immigrants across the border, and if so, whether he helped other like-minded radical islamists enter the country.

We are confident all these questions will be addressed by the Department of Homeland Security, the FBI and the government, and that the media – liberal or otherwise – will promptly follow up on these key questions.

The public argument between Apple and the FBI over cracking the encryption on an iPhone used by the San Bernardino Muslim terrorists is one of those ongoing civil liberties debates that negotiate the terms on which we are asked to sacrifice our civil liberties for the sake of Muslim immigration.

We have already made a thousand accommodations and we will make a thousand more. There will be more databases, naked scanners, eavesdropping, vans that can see through walls, backdoors to every server, registrations, warrantless searches, interceptions and regulations. There will be heavily armed police on the streets. And then curfews and soldiers. These things exist in Europe. They’ll come here.

Some libertarians will argue that we should have none of this and no restrictions on immigration. That we should just shrug off each terror attack and move on with our lives.

Eventually though there will be a terror attack that we can’t shrug off and that can’t be minimized by using the cheap statistical trick of comparing Terror Attack X to the number of people who die every year from cancer. Or there will just be an endless parade of daily attacks, bombings, stabbings or shootings, as in Israel, which create a constant climate of terror that will preclude any hollow rhetoric about the number of people falling off ladders each year or getting struck by lightning.

Some hawks will cheer every terror fighting measure short of closing the door on the root cause of the problem. They would rather see every American wiretapped, strip searched and monitored every hour of the day then just stop the flow of Muslim terrorists into this country.

The encryption methods of an iPhone, like the question of how many ounces there are in your tiny bottle of mouthwash, would not be much of an issue, if Muslim migration did not make it one.

Terrorists adapt to the terrain. They use the native population as protective coloration. They can find a way to transform a shoe, a tube of toothpaste or instant messaging on a game console into a terror tool. Just as the left can ‘politicize’ everything, Muslim terrorists can ‘terrorize’ everything. When everything is a potential terrorist tool, then there can be no such thing as privacy or civil rights.

Muslim immigration is forcing us to constantly choose between our lives and our civil liberties. It’s a Catch 22 decision with no good choices. Terrorists push governments toward totalitarianism so that their own alternative totalitarian state starts to seem like a less terrible alternative. But the refusal to fight terrorism also makes the totalitarian state of the terrorists more viable.

With every Muslim terror attack, successful or only attempted, they win and we lose. The pressure of terror attacks discredit Western ideologies and worldviews, both on the right and the left. Each attack helps generate new converts for Islam and more political influence for Islamist organizations.

Vociferous debates over the choice between civil liberties and security make it seem as if we have to choose between our worldviews because something in our society is the problem. It isn’t.

We do not have an American terror network problem. The Amish aren’t using iPhones or obscure apps to coordinate terror attacks. We have a Muslim terror network problem. It’s not because of the Methodists that we have to weigh our mouthwash or take our shoes off and put them in a greasy plastic tray at the airport. It’s because 19 Muslims entered this country, hijacked our airplanes and murdered thousands of Americans. Guantanamo Bay is not an issue because Buddhists are at war with America. It’s an issue because Muslim terrorists are at war with America.

We do not have an iPhone encryption problem or a shoe problem or a mouthwash problem. We have a Muslim terror problem.

Whatever decision is made about iPhone encryption will not be the last word. The simple reality is that privacy carries too high a price as long as we have large numbers of people in this country who want to kill us in equally large numbers. If we want our privacy back, it’s not the FBI that is standing in our way. It’s the religious organizations that are paid to bring Muslim “refugees” to this country. It’s the liberal, libertarian and even conservative voices that think there is something wrong with pausing the mass migration of the group that is disproportionately responsible for our terror problem. It’s the media that would rather discuss anything and everything than discuss the problem we are really dealing with.

The source of this problem is not whether the FBI handled the iPhone correctly or whether Apple should be obligated to build a way for law enforcement to access its devices. These arguments would exist even without Muslim terrorism, but they would lack the same level of life and death urgency.

This is not an iOS problem. It’s an immigration problem.

The San Bernardino massacre by Muslim terrorists would not have happened without Muslim immigration. The security flaw here was not in the work of FBI agents or of Apple programmers, but of our immigration laws. Just as we cannot and will not intercept every single Muslim terrorist who finds a way to hide explosives in his underwear, shoes, soda or laptop, we will not ever be able to crack every single encrypted Muslim terrorist device. And their underwear bombs and encrypted iPhones would not be an issue if we did not have Muslim terrorists in America in the first place.

Instead of discussing the Islamic root cause, we put stress on our own competing institutions, technology providers face off with law enforcement, hawks and civil libertarians berate each other as if they were each part of the threat. But we are not the problem here. They are the problem.

The only backdoor that should be at issue here is the one that Muslim terrorists use to enter America. We don’t need to violate everyone’s rights to close it. We just need the political will to do the common sense thing and shut down the source of the threat. Either that or give up on our privacy.

Our choice is very simple. We can have external security or an internal police state. But neither of the above is not an option. We can have open borders that fill our country with criminals, but that means that eventually any livable middle class neighborhood will have a cop on every corner. We can have airport security for the people coming into this country. Or we can have airport security for everyone.

Ongoing Muslim migration makes a police state inevitable. But to avoid the perils of profiling and the appearance of discrimination, it will be a universal police state that will strip away rights from everyone without regard to guilt or innocence in the hopes of averting the next Muslim terror attack.

The only way to protect our lives and our freedoms from Muslim terrorism and its consequences is by shutting down Muslim immigration. If we fail to do this, then we will lose our lives and our liberties.

The FBI mishandled the case of an Islamic State terrorist linked to the murder of four Americans in Benghazi, the chairman of the Senate Judiciary Committee says.

Sen. Chuck Grassley (R., Iowa) wrote a letter to James Comey, the FBI director, and Loretta Lynch, the U.S. attorney general, earlier this month regarding Ali Awni al Harzi, a Tunisian recruiter and arms trafficker for the Islamic State (IS, also known as ISIS or ISIL) who was killed in a U.S. drone strike last month.

Just after the Sept. 11, 2012, attack on the U.S. diplomatic mission in Benghazi began, al Harzi is reported to have posted messages on social media about the fighting, which assisted U.S. intelligence in later finding him in Turkey. He was then transferred to Tunisian authorities.

Once in Tunisian custody, he was eventually released in January 2013 after being interviewed for three hours by FBI investigators. He went on to join IS in Iraq.

Grassley asks in his letter how al Harzi “somehow slipped out of our government’s reach,” despite his reported links to Ansar al-Sharia, an al Qaeda-affiliated group that is believed to be a key perpetrator of the Benghazi assault. Militants killed four Americans in the attack, including Ambassador Chris Stevens.

“Although al Harzi was on our radar in 2012 for his terrorist activities, he somehow slipped out of our government’s reach, only to continue his terrorist career for years,” Grassley wrote. “This raises important questions about the Obama administration’s policies and procedures related to the apprehension, interrogation, and detention of terrorists and the roles of the Justice Department and the FBI.”

FBI investigators were finally able to interview al Harzi in December 2012 after months of requests to Tunisian authorities. In addition to his social media postings, U.S. officials have said video footage captured al Harzi at the attack on the consulate in Benghazi and made him a “person of interest.”

Yet a Tunisian judge released him in January 2013—a move opposed by the attorney general’s office in the country—citing a lack of evidence. According to Grassley’s letter, Hillary Clinton, U.S. secretary of state at the time, told lawmakers in congressional testimony that she was “assured that [al Harzi] is under the monitoring of the court” after his release. She also consulted Robert Mueller, then the FBI director, about his case.

“He was released, because at the time—and Director Mueller and I spoke about this at some length—there was not an ability for evidence to be presented yet that was capable of being presented in open court,” Clinton said.

Tunisian authorities eventually lost track of al Harzi, who had joined the Islamic State, also known as ISIS or ISIL. Seth Jones, a terrorism expert at the RAND Corporation, told the New York Times that al Harzi’s “links with ISIL recruitment and financial networks in such locations as Europe, Africa and the Persian Gulf helped ISIL expand from a local group to a more globalized organization.” U.S. forces relocated al Harzi last month in Mosul, Iraq, where he was killed in a drone strike.

Tom Joscelyn, a senior fellow at the Foundation for Defense of Democracies and an expert on jihadist networks in the Middle East, said that U.S. officials have never explained why they allowed al Harzi to walk free. Tunisian authorities did not appear to monitor al Harzi very closely after his release, he said, despite their assurances to the Obama administration. And U.S. officials apparently chose not to use a wealth of evidence at their disposal to further prosecute him, including social media posts, details from the FBI interview, or other classified information, he added.

“None of the excuses that were made for him being released, or for not being concerned about his release, made any sense,” Joscelyn said.

In his letter, Grassley posed several questions to the FBI and Justice Department, including why al Harzi was not extradited to the United States, and why classified information was not used in a criminal case against him. He also asked whether officials considered a military operation to retrieve al Harzi.

U.S. special operations forces captured Ahmed Abu Khattala, leader of Ansar al-Sharia in Benghazi and the suspected coordinator of the 2012 attack, in a raid last year.

While questions remain unanswered about al Harzi’s release, the House Select Committee on Benghazi has been attempting to obtain all government records pertaining to the attack and then issue a final report.

Rep. Jim Jordan (R., Ohio), a member of the committee, said the State Department’s response to records requests has been “pathetic.” According to a recent report, some emails between Clinton and her top aides—which involved the Obama administration’s talking points about the attack—were withheld from the committee due to “deliberative process privilege.”

“We’re not going to have a complete record,” Jordan said. “We’re just going to have do the best we can, and try to get the information for the American people and also importantly for the families of those four individuals” who were killed.

Neither the FBI nor the Justice Department responded to requests for comment for this article. A spokesman for Clinton also did not respond.

Mueller, the former FBI director, declined to comment through a spokeswoman

That Simpson and Soofi were permitted to get so far is best explained by a certain weakness in the human intelligence capabilities of US and Western intelligence, the shortage of undercover agents able to mingle in communities and populations with the potential for producing radical elements capable of committing terrorist murder and suicide in the name of their faith. These agents must be able to pass unnoticed in mosques, bazaars and cafes, and have an ear for local dialects, street talk and inflections, so as to catch onto dangers through innuendo.

The two American gunmen who Sunday, May 3, tried – and failed – to shoot up an exhibit of caricatures of the Prophet Mohammad at the Curtis Culwell Center in Garland, northeast of Dallas, sounded a wakeup call for US intelligence and counter-terrorism agencies – even before the Islamic State warned that this first attack on US soil would not be its last. The two homegrown terrorists, Elton Simpson, a Christian who converted to Islam, and Nadir Soofi, son of a Pakistani father and American mother, carried submachine guns and explosives and wore body armor – attesting to the existence of an organization behind the attack.

That organization is believed to be made up of small sleeper cells of two to three terrorists each, ready to spring into action on orders from distant controllers.

Both were young men in their mid-twenties. The half-Pakistani Muslim Soofi scraped a living from cleaning carpets, while Simpson was out of work. They failed to perpetrate mass murder because they made every possible mistake. And so after inflicting a scratch on one of the unarmed guards, both were shot dead by local police officers securing the “Muhammad Art Exhibit and Contest” at the Curtis Culwell Center, which offered a $10,000 prize for the best artwork or cartoon depicting the Prophet.

For the past two years, Simpson and Soofi have been running posts and images on Twitter, Facebook and Instagram extolling the Islamic State in Iraq and the Levant (ISIS) and all its works, threatening American Christians with revenge and declaring that terrorist attacks were coming.

Shortly before the Dallas event opened, an explicit threat to mete out punishment to those insulting the Prophet Mohammad in Texas, like in Denmark and Paris, appeared on a Twitter account (since de-activated) belonging to AbuHussainAlBritani, known to security services as an ISIS platform.

Simpson had been known as an FBI target since 2010. Then, he made no secret of his plans to travel to Somalia, take advanced studies in Islam and die as a martyr. He was arrested , convicted only of making a false statement to the forces of the law and released on probation. After that, a double agent persuaded him to talk for hundreds of hours on tape, candidly admitting that he intended one day in the future to take part in a deadly terrorist operation.

Yet Simpson was not detained, or even placed under extra surveillance.

Data flowing from Open Source Intelligence (OSINT) is critical in the war on terror: social networks like Twitter and Facebook serve terrorists around the world widely for passing information, arranging rendezvous, filling in the gaps of operational directives and, above all, disseminating their messages.
The US National Security Agency, as well as European and other agencies, maintain blanket surveillance of the social networks, transferring their content in almost real time to giant computers at agency headquarters for filtering and analysis. It is hard to understand how the radical online messages and outspoken tweets by Soofi and Simpson, which left no room to doubt their intentions, escaped interface by those computers with their past records and views.

The pair was therefore free to drive from Arizona to Texas in late April, in a car registered in one of their names, and armed with machine guns.

They pulled up at the Curtis Culwelll center, where the Mohammed cartoon exhibit opened in the presence of Pamela Geller, president of the American Freedom Defense Initiative (AFDI), which has sponsored anti-Islamic advertising campaigns across the country, and Geert Wilders, a Dutch politician and anti-Islamic campaigner who is on an al Qaeda hit list. When they reached their destination, they were not stopped until they actually started shooting – and only then thanks to the fast reflexes of a police guard on the spot.

That Simpson and Soofi were permitted to get so far is best explained by a certain weakness in the human intelligence capabilities of US and Western intelligence, the shortage of undercover agents able to mingle in communities and populations with the potential for producing radical elements capable of committing terrorist murder and suicide in the name of their faith. Digital intelligence, however extensive, is no substitute for human intelligence. It takes an undercover human agent on the ground to pick up on terrorist threats in time to thwart attacks.
