(Earlier “American law for American courts” legislation had been problematic because it prohibited consideration of foreign laws even in business contexts where, for example, an American company had entered into a contract with a German company providing for situations where German or American law business law would apply. Texas Governor Greg Abbott signed into law House Bill 45, more commonly known as “American Laws for American Courts,” or ALAC. It prohibits the use of any foreign law in the state’s courts, specifically in family cases that involve marriage or parent-child relationship matters.

One of the bill’s co-authors Representative Jeff Leach (R-Plano) thanked the governor, who signed HB 45 on Wednesday. Leach called the law “vitally important bill to further safeguard and protect our Constitutional rights!” In the last legislative session, Leach authored the comparable yet unsuccessful ALAC measure, House Bill 562.

HB 45 lead author Representative Dan Flynn (R-Canton) also introduced similar past legislation that failed. In a recent press release, Flynn noted foreign law is often applied in Texas cases concerning divorce orders, child support, property settlements and sometime even, spouses enter into agreements to have foreign law applied to their disputes.

“My colleagues and I here at the Texas Legislature want to make sure Texas judges never apply foreign law in Texas courts in violation of constitutional rights and the public policy of our state,” said Flynn.

Under HB 45, Texas and U.S. law supersede all other laws. It prevents state judges from applying any foreign law because, in doing so, it infringes upon U.S. and Texas constitutional rights. The bill shields litigants in family law cases “against violations of constitutional rights and public policy in the application of foreign law” under the U.S. and Texas Constitutions, federal and judicial precedent, the Texas Family Code, and the Uniform Child Custody Jurisdiction and Enforcement Act, among other protections.

HB 45 makes no mention of any particular foreign nation, religion, or cultural practice but clarifies that “foreign law” means a rule, law, or code from a jurisdiction outside of the United States and it shall not override U.S and Texas law or their respective constitutions. It specifies that a “foreign judgment” means a ruling from a court, tribunal, or administrative adjudicator outside U.S. states and territories. The bill underscores that, in the event of any legal conflicts, “federal or state law prevails.”

In January 2015, Breitbart Texas confirmed in a report that an Islamic tribunal using Sharia law operated in Dallas. Dr. Taher El-badawi, one of four attorneys who called themselves “judges” and not arbitrators, claimed the tribunal and its decisions were “voluntary.” El-badawi said the tribunal operated under Sharia as a form of “non-binding dispute resolution” in civil disputes in family and business cases but also admitted that when in conflict between Sharia and Texas law, “we follow Sharia law.”

In December 2015, Flynn asked Attorney General Ken Paxton “the extent to which current law authorizes or requires a judge of a state court to apply foreign law in certain family law disputes.” Last year, Paxton ruled in a seven-page nonbinding legal opinion: “Under Texas law, a court is not required in family law disputes to enforce a foreign law if enforcement would be contrary to Texas public policy or if it would violate a party’s basic right to due process.” However, according to the Attorney General’s office, Paxton’s opinion only constituted a written interpretation of existing law and did not decide any law.

The Texas chapter of the Council for American-Islamic Relations (CAIR) called HB 45 anti-Sharia law and lobbied for the state’s Muslim community to oppose the bill. “We believe it prevents Muslims from practicing their faith in areas such as Islamic marriage, divorce, funeral procedures, and civil agreements, they said in a press release.

HB 45 requires the Texas Supreme Court adopt its rules by January 1, 2018. The law goes into effect on September 1, making Texas the 12th state to enact ALAC. The other states are Alabama, Arizona, Florida, Kansas, Louisiana, Mississippi, North Carolina, South Dakota, Oklahoma, Tennessee, and Washington, according to ACT for America.

A report by the Texas Department of Public Safety raises concerns about ISIS terrorists using the Mexican border both to enter and leave the country. It noted that at least 13 aspiring terrorists have tried to cross into Mexico, or considered trying, since 2012.

Most of those cases involved people who knew they were on the federal no-fly list but wanted to travel to join terrorists, the report said. Sneaking across the southern border “presents an opportunity for increasing numbers of aspiring foreign terrorist fighters to evade US interdiction efforts such as the No-Fly List.”

The most recent example happened in October. Texas authorities arrested two Milwaukee men near San Angelo, Texas on the way to the Mexican border. Jason Ludke, 35, and Yosvany Padilla-Conde, 30, wanted to go to Mexico, obtain fraudulent travel documents and travel to join ISIS in Syria or Iraq.

In another instance in April 2015, seven Somali men from Minnesota tried to cross from San Diego into Mexico in an effort to get to Syria and fight for ISIS.

Texas resident Bilal Hamed Abood, an Iraq-born naturalized U.S. citizen, successfully used the border in 2013 to travel to Syria, where he fought for a Syrian rebel group. The FBI arrested Abood for lying about his initial travel to Syria when he tried to come home through the Dallas-Fort Worth airport. Abood claimed he fought for a faction that was not prohibited under U.S. law. However, FBI agents search his computer and found that he took an oath of allegiance to ISIS leader Abu Bakr al-Baghdadi.

Texas authorities voiced concern in 2014 about ISIS social media threats to use the Mexican border to enter the United States.

In a criminal complaint filed last year, alleged ISIS supporter Erick Jamal Hendricks claimed to have had contact with an ISIS supporter known as “Abu Harb.” “Abu Harb” told Hendricks that he was in Dallas and that the “Islamic State had brothers in Mexico.”

Previously, government officials warned about threats to the U.S. border posed by other terrorist groups including Al-Shabaab and Hizballah.

President Trump touted the ISIS threat as a reason for building his wall along the Mexican border during the campaign. He signed an executive order Wednesday calling for the wall’s construction, but funding sources are not yet clear.

Report: Multiple victims in Austin, Texas shooting

Report: Multiple people injured in Austin, Texas shooting; Shooter still at large Media outlets in the US reported that an armed man opened fire in the center of Austin, Texas this morning. At least one person was killed in the shooting. The local police department ordered residents to remain in their homes.

An armed man began randomly shooting at pedestrians in the center of Austin, Texas this morning (Sunday), according to media outlets in the US. According to the reports, a woman was killed. In addition, multiple people were injured.

Police and medical forces were rushed to the scene. The Austin Police Department instructed residents to flee the scene of the shooting and remain in their homes. It appears that the shooter is still at large. Meanwhile, it was reported that a second shooting occurred at a different scene in the same area. “Both scenes are secure at this time,” wrote the Austin Police Department on its Twitter account.

We’ve never experienced this type of incident in the past,” said Dorian Santiago who was an eye-witness to the shooting. “We aren’t used to this type of crime in this area. We heard five gunshots and then people started running like crazy. There was a young girl who went crazy after she was injured. I saw another one on the ground as they were performing CPR on her but it looked like she was already dead.”

Governor Greg Abbott today informed the Obama administration that Texas will maintain and strengthen its sanctions against Iran. Governor Abbott responded to a letter from the administration requesting that Texas “review” its economic sanctions against Iran. Governor Abbott reiterated his strong opposition to the Iran deal and informed the administration that he will continue to seek new legislation to strengthen existing economic sanctions against the world’s leading state sponsor of terrorism.

“Entering into an agreement with a country that consistently calls for ‘death to America’ and repeatedly articulates anti-Semitic policies is short-sighted and ignores geopolitical realities,” Governor Abbott writes in the letter. “As a strong supporter of Israel, I am committed to doing everything in my power to oppose this misguided deal with Iran. Accordingly, not only will we not withdraw our sanctions, but we will strengthen them to ensure Texas taxpayer dollars are not used to aid and abet Iran.”

During his visit to Israel in January 2016, Governor Abbott met with Israeli Prime Minister Benjamin Netanyahu and announced he would seek legislation to:

Prohibit local government entities in the State of Texas from investing in Iran or entities conducting business with Iran
Require all Texas state entities – not just state pensions – to follow Texas’ divestiture policy
Close additional loopholes in Texas’ current divestiture statute.

Texas Governor Gregg Abbott announced he would not lift the state’s sanctions on Iran, rejecting a request to do so by President Obama and affirming ‘strong support’ for Israel.

Abbott told the Obama administration in a letter that Texas will maintain and even strengthen its sanctions against Iran.

Abbott was responding to a letter from the administration sent in April requesting that Texas “review” its economic sanctions against Iran.

The governor reiterated his strong opposition to the Iran deal, which was sealed with the Islamic Republic last summer, and informed the administration that he will continue to seek new legislation to strengthen existing economic sanctions against Iran, which he termed as the “world’s leading state sponsor of terrorism.”

“Entering into an agreement with a country that consistently calls for ‘death to America’ and repeatedly articulates anti-Semitic policies is short-sighted and ignores geopolitical realities,” Abbott wrote in the letter.

“As a strong supporter of Israel, I am committed to doing everything in my power to oppose this misguided deal with Iran. Accordingly, not only will we not withdraw our sanctions, but we will strengthen them to ensure Texas taxpayer dollars are not used to aid and abet Iran,” he stated.

During his visit to Israel in January, Abbott met with Prime Minister Benjamin Netanyahu and announced he would seek legislation to prohibit local government entities in the State of Texas from investing in Iran or entities conducting business with Iran, a law that requires all Texas state entities, and not just state pensions, to follow Texas’ divestiture policy, and further legislation to close additional loopholes in Texas’ current divestiture statute.

“Given all the flaws that are inherent in the Iran deal, Texas is absolutely committed to maintaining its sanctions against Iran,” the letter reads.

Meeting with the Jewish media in New York over the weekend, Abbot said he is “deeply disturbed” by the nuclear deal and views it as “a potential existential threat to Israel and frankly to nations across the globe.”

“It makes no sense to me why the United States would be an accomplice to arming and aiding economically a nation that to this day seems to be devoted to terrorism,” he said at the meeting, according to the Jerusalem Post.

“Israel has no stronger ally in the United States than the State of Texas,” he added. “Texas is going to take the lead in sending the message to the international community that we stand with Israel.”
