alestinian Authority Foreign Minister Riyad al-Maliki was expected on Thursday to personally deliver to the International Criminal Court files describing alleged Israeli crimes in the West Bank and Gaza.

The move by the Palestinians marks a first step toward opening criminal proceedings against the Jewish state, and comes days after a UN panel found Israel could be guilty of war crimes during fighting in Gaza last summer.

Maliki was to present the files, which mainly contain background data and statistics, for review by ICC Chief Prosecutor Fatou Bensouda.

The files describe Israeli control in the West Bank, arrest policies, and daily life.

A team of ICC investigators is scheduled to arrive in Israel by the end of the month to examine Palestinian allegations of Israeli war crimes and crimes against humanity in the West Bank and Gaza Strip, though Israeli officials have described the visit as routine.

The files to be presented by Maliki are intended to aid Bensouda in deciding whether or not to upgrade the preliminary probe into a full investigation of criminal activity.

A decision to order a full investigation can only come from judges in the ICC’s pretrial department.

Should the review lead to an investigation, the court may also look into crimes allegedly committed by the Palestinians as well.

The Palestinian Authority officially joined the International Criminal Court on April 1, after having signed the court’s founding treaty, the Rome Statute, last December.

Though Israel is not a member of the court, cases could be brought before it against Israeli individuals suspected of war crimes committed in territory claimed by the Palestinians.

In January, Bensouda initiated an investigation into alleged war crimes committed by Israel during last summer’s war between Israel and armed factions in Gaza.

On Monday, a report by the UN Human Rights Council found Israel and Palestinian groups could have committed war crimes, and urged The Hague to launch an investigation.

Israel has dubbed the Palestinians’ joining the court as “scandalous,” with Prime Minister Benjamin Netanyahu warning that it turns the ICC “into part of the problem and not part of the solution.”

Meanwhile, the Israeli non-governmental organization Shurat Hadin-Israel Law Center has begun collecting incriminating information on Palestinian leaders as a deterrent measure at the ICC.

Earlier this week Shurat Hadin petitioned the ICC demanding that the court disqualify Bensouda from dealing with the matter because she has already made comments to the media about the Israeli-Palestinian situation, contravening the court’s own guidelines, the Hebrew-language Ynet website reported.

U.S. Ambassador Dan Shapiro told Israel radio stations Thursday that the best way for Israel to fight the Boycott Israel movement is simply to return to negotiations with Mahmoud Abbas, who has conditioned talks on Israel’s agreeing ahead of time to all of his demands.

The issue of BDS has been flying high this week, first with the empty resolution by the British Students Union to join BDS. That was followed up with yesterday’s bombshell statement by an official of the French-based Orange company that it would like to be rid its agreement with Israel’s Partner mobile phone company because of pressure by BDS, which complains that Israel has built more than 100 transmitting antennas on “occupied land” and operates four outlets in Judea and Samaria and eastern Jerusalem

Here comes the United States of America to the rescue.

Shapiro said on Army Radio and Reshet Bet (Voice of Israel) that of course the Obama administration is against boycotts of Israel, which can count on America as its best friends.

The Hebrew-speaking ambassador said:

We staunchly oppose any effort to delegitimize or boycott or sanction Israel. We will never support this. We will fight together with Israel against all these efforts.

And how will it do that?

Shapiro has the simple answer, which could come only from a simpleton’s mindset: The problem is that now there are no negotiations. Shapiro told Israel Radio:

In the past when there were negotiations, that was the most effective tool to tell other countries, perhaps private companies as well, not to impose sanctions because that would upset efforts to reach a solution.

The boycott movement has deep roots in the Arab world, which boycotted Israel long before the Six-Day War in 1967, when Jordan fled territory, most of which it had occupied since 1948 without a United Nations mandate, and left it in Israel’s hands.

The newer “Boycott, Disinvestment and Sanctions” campaign started in 2005, when Israel still was in the midst of marathon “negotiations” in which it conceded point after point and to the Palestinian Authority, with the forceful hand of the Bush administration.

Shapiro may or not believe what he said was true, but he has to be given an “A” for spouting the Obama administration’s magic potion that is based on a bald-faced lie. Obama is against boycotting Israel because he prefers the “diplomatic process,” but he shares the BDS goal of making Israel too weak to exist, although his too naive to know it.

Since taking office, President Barack Obama never has wanted anything more than a Palestinian Authority country to be established, even more than he wants a nuclear-free Iran.

The President regards  himself as an “honorary member of the tribe” thanks to the well-wishers of J Street and Jewish “liberals” who are uncomfortable being Americans while Israel does not do what their president tell it do.

Obama has craftily convinced himself that Judaism teaches that Arabs must have a new country within Israel’s country’s border, and if it does not, then Judaism is doing something wrong.

He has Shapiro, a Jew, and a few other members of the tribe, acting as “good Jews” to kick their brethren in Israel who simply do not understand their duty as Israelis.

Obama and Shapiro know very well that Israel does not sit down with Ababa for negotiations because the leader of the Palestinian Authority does not want to negotiate. He has no reason to compromise because he has the back of the Obama administration, which on the one hand says that it will not force conditions on Israel and on the other hand lets Abbas set the terms.

It is no wonder that Shapiro also told Israel radio today:

We are in a period without negotiations and there is not even a possibility of launching negotiations in the near future. Negotiations have always been the most effective tool to defeat all of these efforts. This is also the best way to advance toward a solution of two states for two peoples.

He frankly states that is no possibility of negotiations now, and President Obama says the same.

The Obama administration has turned “the two states for two peoples” mantra into some kind of voodoo prayer to be recited every time someone threatens Israel, whether with bombs or boycotts.

Shapiro claimed “that when we held negotiations together with the Israelis and the Palestinian Authority it was the most effective tool to tell other states and private companies, ‘Don’t impose these proposals because you will interrupt the efforts to arrive at a solution.’”

And what is the solution?

It is expelling 10 percent of Israel’s population from Jerusalem, Judea and Samaria and withdrawing the IDF from Judea and Samaria as it did from Gaza in 2005.

That has been the Palestinian Authority tactic. Tear apart the Oslo Accords clause by clause, win a concession and then move in for the lethal blow of making Israel the home for several million Arabs living as prisoners of UNRWA in foreign countries.

Obama supports Abbas’ conditions for a new Arab country, but the conditions actually are Obama’s terms for the existence of Israel, which the President does not realize cannot continue to breathe in his fantasy.

Shapiro maintains that the United States will not prematurely “recognize a Palestinian state that does not exist.”

The Obama administration policy is to create facts on the ground that the Palestinian Authority become a member of the United Nations a de facto state, without Jews, in violation the U.N. charter.

And then, according to Shapiro, BDS will fold up and go away, just like Chamberlain could sleep in peace after Hitler would annex Czechoslovakia.

It is not so much of a problem that Shapiro expresses Obama’s holy delusion.

The real problem is that Obama, the honorary member of the tribe, actually believes it.

The Islamist group that fired rockets at southern Israel Wednesday night said Thursday that it would continue its “way of Jihad” and “attack the Jews” – whether or not Hamas approved. And the next attack, it said, would come within hours.

In a statement, the “Sheikh Amar Hadid Brigades” said that the rockets were fired in revenge for “the death of an Islamic State member in Gaza by Hamas members.”

“We have repeated that we will continue in the way of Jihad against the Jews, the enemies of Allah. No one will stop us from fulfilling our obligation and attacking the Jews.”

Several days ago, the same jihadist group took responsibility for the firing of a Grad rocket at Ashdod last week.

The group has since presented Hamas with an ultimatum demanding that it be allowed to attack Israel from Gaza and on Thursdaysaid it would conduct another attack on the Jewish state within 12 hours.

Earlier this week, a group claiming to be associated with ISIS operating in Gaza claimed it killed a top Hamas commander. According to the group, which calls itself the Army of the Islamic State, Saber Siam was killed when ISIS operatives placed a bomb on his car, blowing it up with him inside.

Siam was killed, the group said, because he was “a partner in a declared war against religion and against Muslims, working for the heretical government in Gaza.”

ISIS warned Hamas to immediately “end its war against religion in Gaza” or “face the consequences.” The group also sent out warnings on social media to Gaza residents to stay away from Hamas offices and buildings, lest they find themselves swept up in attacks against the group.

On Thursday, Defense Minister Moshe Ya’alon said that the IDF would continue attacking all terror threats against Israel, inside Gaza or out of it.

“Even if the groups that fired rockets at Israel Wednesday night were gangs of disaffected Jihadists seeking to challenge Hamas by attacking us, we see Hamas as responsible for these attacks. We will not tolerate attacks on our civilians.”

According to a report published by Palestinian dissident Walid Shoebat, Turkish President Recep Tayyip Erdogan and Turkish Prime Minister Ahmet Davutoglu spoke during the inauguration ceremony of the country’s 55th airport in Hakkari Province.  The airport is named the Selahaddin Eyyubi Airport after Saladin of the Ayyubi dynasty, the Muslim ruler of Kurdish origin that conquered Jerusalem and was a great enemy of the Christian Crusaders especially Richard the Lionheart.  During the ceremony, both Turkish leaders spoke of their desire to conquer Jerusalem and to re-establish the Ottoman Empire.

“By Allah’s will, Jerusalem belongs to the Kurds, the Turks, the Arabs, and to all Muslims,” Davutoglu declared.  “And as our forefathers fought side by side at Gallipoli and just as our forefathers went together to liberate Jerusalem with Saladin, we will march on the same path to liberate Jerusalem.  The Turkish government does not differentiate from East to West.  We intend to put together all of the regions of our nations and we will bring these regions back together.”

Erdogan’s speech was even more grandiose.   He proclaimed himself to be the reincarnation of Saladin, who will kick whom he perceives to be the modern day crusaders out of Jerusalem by uniting the Muslim world behind him by hinting at the re-establishment of the Ottoman Empire: “I am sure that the great commander Saladin is bringing together all of the peoples of the Middle East into the one army that defeated the Crusaders.  Saladin is currently witnessing what we are doing here spiritually.  I was in his spiritual presence and I am addressing him here in Hakkari with the mighty men, be it eastern, brave south-eastern, valiant Anatolian in Old Turkey.”

“Jerusalem is for the Muslims and not for Israel,” Erdogan added.  “Why should we continue to be friends with those that stomped their boots on the Temple Mount?  They insist that we have to be friends?  I say, we will not.”   Erdogan promised to follow in Saladin’s footsteps: “They all promise you O Saladin, if you united the brothers in the Middle East, so will we.  Saladin said ‘Jerusalem is not for the Crusaders.’  Saladin witnessed this.  Allah witnesses this.  One people, one flag, one nation and one state!”

China is concerned for the U.S.

The Chinese have told U.S. nuclear specialists that North Korea may have as many as 20 nuclear warheads, and has the domestic capability to reach 40 nuclear warheads by 2016 and 75 by the end of the decade, according to a Wall Street Journal report.

And while an arsenal like that is enough to affect regional stability, it is believed the North Koreans can now mount their nuclear warheads on their homegrown KN-08 ICBMs, with their 5600 mile range, and reach as far as California.

If that wasn’t problematic enough, North Korea managed to build up their nuclear aresenal and ICBMs after the 1994 nuclear agreement between North Korea and the Clinton administration, an agreement which was meant to halt their nuclear development capabilities.

North Korea tested their first nuke in 2006.

That deal which relied on IAEA verification was negotiated by Wendy Sherman, who is now negotiating the current Iran deal.

James Baker described Sherman’s negotiating strategy as one of “appeasement”.

Until now, China underestimated North Korea’s capabilities, the WSJ reports:

Until recently, the Chinese “had a pretty low opinion of what the North Koreans could do,” said David Albright, an expert on North Korea’s nuclear weapons and head of the Institute for Science and International Security in Washington. “I think they’re worried now.”

If the next sentence sounds familiar to you, it should,

U.S. officials didn’t attend the meeting but some expressed surprise when they were later briefed on the details, said people familiar with the matter.

Talking about surprises and not knowing what was going on in secret nuclear facilities, let’s move on to Iran.

There’s a debate raging as to how long President Obama has actually known that Iran was far closer to nuclear weapons than he recently admitted, and as Prime Minister Netanyahu has been warning all along.

North Korea has been exporting their nuclear know-how and technology to Iran, Syria and other Mid-East countries for a long time.

Israel blew up at least one suspected Syrian nuclear facility in 2007.

The Iranians are very tight with the North Koreans and their nuclear program. Some believe Iran helped finance North Korea’s program, just like some believe Saudi Arabia financed Pakistan’s nuclear program. Essentially outsourcing the development and risk.

With the injection of signup bonus money and post-sanctions business into Iran, we may see larger investments in North Korea’s nuclear program.

But even if that wasn’t the case, the fact that North Korea was able to develop their nuclear arsenal under the US and China’s nose, despite the Clinton treaty, should be setting off alarms as to what Iran, who will probably use the same North Korean playbook as U.S. Rep. Ed Royce (R., Calif.), chairman of the House Foreign Affairs Committee warns, will be able to do under Obama’s bad deal – with a lot more money in their pockets and freedom of action.

They can’t even coordinate their public descriptions of what the deal entails, that’s how bad it is.

The sort of, kind of nuclear agreement between the P5+1 and Iran makes concrete the previous understanding that U.S. President Barack Obama has been dead wrong about almost every major terrorist threat he has encountered: Al Qaeda is not, as he intoned, “decimated”; ISIS is not a “junior varsity” terrorist network; and Iran is not a partner with whom the west can successfully negotiate.

It looks like the U.S. is the captain of the junior varsity team. And Israeli Prime Minister Netanyahu will not sugarcoat his assessment.

This “agreement” which is not a deal, is not even the framework of a deal, is, ultimately, an attempt by the Obama administration to rack up at least one foreign policy “achievement” during its tenure.

But that “achievement” confuses an end date to a series of discussions with the attainment of even the modest goals this administration claimed it would reach.

What follows are key details which have been released about the “agreement” reached between the U.S.-dominated allies known as the P5+1 (the junior varsity) and Iran, regarding the latter nation’s nuclear program.

A quick perusal makes clear the U.S. administration’s insistence that diplomacy would safely ensure Iran would not become a threshold nuclear power was exactly what its critics claimed: a hollow gesture which rewarded Iran with its goal of more time to continue in pursuit of achieving that status. What’s more, the deal which the parties are currently hurtling towards will not only permit but will actually legitimize Iran in its achievement of that status.

CENTRIFUGES

Iran currently has 9,000 operational centrifuges (that is the generally accepted number). The U.S. claims that, under the terms of the new deal, about 3,000 fewer Iranian centrifuges will be operational during the next 10 years, while 5,060 centrifuges will continue enriching uranium during that period.

The U.S. also claims that Iran will not use “advanced” centrifuge models for 10 years, and any development will be in accordance with P5+1 oversight. The Iranians say nuts to that, and will continue doing research and development on advanced centrifuges during the duration of the 10 year period.

Fordow, the uranium enrichment plant built in an underground bunker, will be used for “peaceful purposes.” The U.S. claims that Iran will move two-thirds of its centrifuges out of this facility and will not enrich uranium there for at least 15 years.

In other words, even according to the U.S. version of the facts, and even were one to believe that Iran will strictly adhere to its obligations under this “pre-deal,” Iran gets to continue enriching uranium, thousands of centrifuges will continue spinning, and the underground bunker will have operational centrifuges during the term of the deal.

CURRENTLY ENRICHED URANIUM

The U.S. claims that Iran’s acurrently enriched uranium will be reduced. That is already a three-step default by the allies. Initially, all enriched uranium was to be destroyed. As the result of negotiations the Iranians had allegedly agreed to instead move its already enriched uranium to Russia, where it was to be converted for non-military use.

Instead, the U.S. is reduced to bragging about a mere “reduction” in Iran’s already enriched uranium. And we don’t know what is meant by “reduction” or “neutralization” – another term used in the U.S. fact sheet.

According to a former CIA analyst, “If Iran’s enriched-uranium stockpile remains in the country,” and if it is only converted to powder form, which the Obama administration had previously – erroneously – claimed meant it would be neutralized, “Iran will retain the capability to make about eight or more nuclear weapons in about three months.” Maybe little league rather than junior varsity players more accurately describes Secretary of State John Kerry and his negotiating team.

INSPECTIONS

The inspections terms and verification measures allegedly stipulate that Iran will be required to allow inspectors from the International Atomic Energy Agency access to Iran’s facilities and possible covert enrichment sites. However, there appears to be no requirement that Iran will permit “snap” inspections and unfettered access to all of Iran’s nuclear facilities. This is not only a concern because of the standard enrichment facilities, but it does not appear to include guaranteed access to Iran’s military bases. Iran is suspected to have worked on military dimensions to its nuclear program at some military bases.

SANCTIONS

There is a stark disparity between Iran and the P5+1’s characterization of when international sanctions would be lifted against Iran.

The Iranian leadership had recently been pressing its team to ensure that there would be an immediate lifting of economic sanctions against the Islamic Republic once a deal was reached. Indeed, that is the way the Iranian team has characterized the agreed-upon timing for sanctions relief regarding Iran’s nuclear program (other human rights-based and other sanctions currently in place on Iran are unaffected by this deal).

The U.S. claims that sanctions will be lifted after the IAEA verifies that Iran has complied with “all of its key nuclear-related steps.” These sanctions will “snap back” if Iran fails to comply with its commitments.

The snap-back image is a good one, but no one really believes there will be any snap in the response, let alone a determination of whether Iran is in compliance, especially given the pass it has already been given on so many violations of previous commitments.

ISRAELI RESPONSE

During the recent election season in Israel, the main parties disagreed about almost everything with one exception: Iran. From the far left members of the Labour/Hatnua party, right through to Likud, Bayit Yehudi and Yisrael Beitenu, the candidates agreed there was no daylight between them and Israeli Israeli Prime Minister Benjamin Netanyahu’s critical position regarding Iran’s nuclear weapons capability.

Speaking after a cabinet meeting about the proposed agreement with Iran on Friday, April 3, Netanyahu said that the cabinet “is united in strongly opposing the proposed deal” which would “pose a grave danger to the region and to the world and would threaten the very survival of the State of Israel.”

After ticking off the many problematic aspects of the deal – that no centrifuges would be destroyed, no nuclear facilities would be destroyed, that it will bolster Iran’s economy just as Iran is increasing its footprint of global terrorism and that it leaves Iran with a vast nuclear infrastructure and the capacity to build a nuclear bomb within a matter of months in just a few years, Netanyahu offered this grave condemnation:

Such a deal does not block Iran’s path to the bomb.

Such a deal paves Iran’s path to the bomb.

And it might very well spark a nuclear arms race throughout the Middle East and it would greatly increase the risks of terrible war.

The Israeli prime minister once again asserted the alternative approach he suggested when addressing the joint houses of Congress on March 3. His suggestion was to increase the pressure on Iran until a good deal is achieved. This approach flips on its head the allies’ approach of giving the carrot to the poorly behaved donkey hoping it will cause the donkey to repent and mend its ways especially after such a reward.

The Israeli prime minister quoted an Iranian commander who said just two days ago, while the Lausanne negotiations were taking place, “The destruction of Israel is non-negotiatble.”

Netanyahu’s response: “I want to make clear to all. The survival of Israel is non-negotiable.”

And then the Israeli prime minister said something which can only mean that Israel will take matters into its own hands if the parameters of the Iran deal are concluded based on the currently understood terms.

Netanyahu said: “Israel will not accept an agreement which allows a country that vows to annihilate us to develop nuclear weapons, period.”

BEIRUT – Islamic State took control of large parts of Palestinian refugee camp Yarmouk in southern Damascus on Wednesday, witnesses and a monitoring group said.

“They pushed from the Hajar Aswad area,” one witness said, adding that the violence was ongoing. Yarmouk has been caught between government forces and Syrian insurgent groups including al Qaeda’s Nusra Front.

The British-based Syrian Observatory for Human Rights reported that Islamic State controlled some of the main streets in the camp and that clashes continued.

 

Syria says Jordan shuts main border crossing
BEIRUT – Syria’s state news agency said Jordanian authorities had closed the main border crossing between the two countries on Wednesday, citing a source in the Syrian foreign ministry.

The source said Syria held Jordan responsible for the social and economic impact of the closure of Nasib crossing, which had blocked traffic.

The British-based Syrian Observatory for Human Rights had reported earlier on Wednesday heavy clashes between insurgents and Syrian forces near Nasib after the insurgents encircled the crossing area.

The commander of the Basij militia of Iran’s Revolutionary Guards said that “erasing Israel off the map” is “nonnegotiable,” according to an Israel Radio report Tuesday.

Militia chief Mohammad Reza Naqdi also threatened Saudi Arabia, saying that the offensive it is leading in Yemen “will have a fate like the fate of Saddam Hussein.”

Naqdi’s comments were made public as Iran and six world powers prepared Tuesday to issue a general statement agreeing to continue nuclear negotiations in a new phase aimed at reaching a comprehensive accord by the end of June.

In 2014, Naqdi said Iran was stepping up efforts to arm West Bank Palestinians for battle against Israel, adding the move would lead to Israel’s annihilation, Iran’s Fars news agency reported.

“Arming the West Bank has started and weapons will be supplied to the people of this region,” Naqdi said.

“The Zionists should know that the next war won’t be confined to the present borders and the Mujahedeen will push them back,” he added. Naqdi claimed that much of Hamas’s arsenal, training and technical knowhow in the summer conflict with Israel was supplied by Iran.

The Basij is a religious volunteer force established in 1979 by the country’s revolutionary leaders, and has served as a moral police and to suppress dissent.

In January, a draft law that would give greater powers to the Basij to enforce women’s compulsory wearing of the veil was ruled unconstitutional.

The force holds annual maneuvers, sometimes with regular Iran units.

IAEA Report Proves Iran Was Researching Nuclear Missiles

Iran was heavily involved in nuclear weapons research, according to documents given to the International Atomic Energy Agency (IAEA) in 2005. To date, Iran has refused to acknowledge this past work on nuclear weapons, but IAEA reports leave no doubt the documents are credible and described research only suitable for a nuclear arms.

With the self-imposed deadline for a nuclear deal with Iran coming this week, now is probably a good time to recall that Iran has been lying about its nuclear ambitions for a very long time. In 2005, an IAEA member state turned over more than 1,000 pages of documents outlining a substantial nuclear research program in Iran. Known collectively as the “alleged studies documentation,” a 2011 IAEA report describes the cache as containing “correspondence, reports, view graphs from presentations, videos and engineering drawings.” The documents also contained “working level correspondence consistent with the day to day implementation of a formal programme.” In short, proof Iran had a sustained nuclear weapons program.

After carefully examining the documents and gathering additional information, the IAEA confronted Iran with the documents in 2008. Iran sent the Agency a 117-page response that confirmed some of the fine details, such as names and places, but denied all the evidence showing a nuclear weapons research project had been underway. Iran claimed the documents were “forged” and “fabricated.”

One of the details contained in the IAEA document cache was evidence that Iran had been studying how it could integrate its planned nuclear weapon with its own Shahab 3 missile (which has a range of 800 miles). Specifically, it wanted to create a firing mechanism that could detonate the nuclear payload in mid-air or upon impact. When confronted with this specific information (which may have included video), Iran claimed it was part of an “animation game.”

The IAEA decided to show the missile plans to experts from other member states (not including the nation that originally gave them the documents). They asked these experts to look at the designs and assess if there was any other military or peaceful application for them other than launching a nuclear weapon. The results of this investigation appear as Attachment 2 in the IAEA’s November 2011 report:

 

 

Clearly, the experts concluded there was no peaceful application for the designs (such as a satellite). And while some elements of the design could have been useful for other types of weapons, the overall combination of elements pointed to only one likely possibility: a nuclear payload.

In addition to the missile payload designs, the “alleged studies documents” indicated Iran was also researching detonators, neutron initiators, firing equipment for an underground test, and many other aspects of nuclear weapons research.

The 2011 IAEA report was an attempt to get Iran to come clean about its past work on nuclear weapons, but thus far, Iran has refused to acknowledge it. As recently as last week, IAEA Director Yukiya Amano has said that Iran still needs to come clean. In an interview with Judy Woodruff of PBS, Amano said, “Our information indicates that Iran engaged in activities relevant to the development of nuclear explosive devices. We do not draw conclusions. But we are requesting Iran to clarify these issues. …So far, there has been some clarification, but the progress has been very limited.”
