Release of 104 long-term Palestinian inmates still must be okayed by president, court

Ministers who voted to release long-term Palestinian security prisoners on Sunday were forced to choose between  ”a bad decision and a worse decision,” Defense Minister Moshe Ya’alon said Monday, as peace talks between Israel and the Palestinians kicked off.

The controversial move, approved after a stormy and lengthy cabinet session, will be carried out in stages and will still need to be cleared by the president and the court, should the release be appealed, Ynet news reported Monday.

Ya’alon said “the considerations that were taken into account” would one day be revealed, and added that security would be increased following the release of the 104 prisoners, many of whom were convicted for murders or terror attacks and have been in jail since before the Oslo Peace Accords of 1993. Ya’alon said security forces would respond with an increase in alertness.

Releasing the prisoners was a Palestinian precondition for peace talks, and while the decision was widely pilloried by politicians on the right and the Israeli public, Prime Minister Benjamin Netanyahu said it was for the “good of the country.”

The release will be in stages linked to continued progress in the talks, which are planned to last 6-9 months.

Justice Minister Tzipi Livni flew to Washington Monday to initiate the first round of renewed peace talks with chief Palestinian negotiator Saeb Erekat, under the auspices of US Secretary of State John Kerry. In conjunction with this, the first round of prisoners is expected to be released later this week.

For each batch, a list of prisoners to be released is to be prepared by the Justice Ministry and approved by Livni. As part of this process, the exact locations where each prisoner will be released will also be determined, which could be in the West Bank, Gaza or potentially abroad. 

After this, the list will be transferred to President Shimon Peres, who will officially sign off on their early release. After this step the list will be made public, allowing citizens to petition the High Court against the release of specific prisoners.

In 2011, the court struck down a petition by families of terror victims seeking to stop the release of some 1,000 Palestinian prisoners in exchange for kidnapped soldier Gilad Shalit. Israel has carried out prisoner swaps several times in the past, usually amid public opposition.

The Prison Service will be tasked with preparing the prisoners, which involves in each case positive identification, medical tests and debriefing with prison officials. Each prisoner will reportedly be asked to sign an agreement that he will not return to terror activity once granted his freedom.

Once all the pre-release steps have been accomplished, each group of prisoners will be driven, under heavy security, to predetermined locations for their release, where they are likely to be greeted by enthusiastic crowds of Palestinians.

    My interpretation:

    Hi guys, Iran is our only real concern and I will do anything to stop it going nuclear, even enter into these, at this time, absurd negotiations with the Palestinians and release murderers to start them.    I do not have much of a choice. Obama is breathing down my neck and I need some room to plan our pre-emptive attack on the Iranian nuclear sites. It was really beyond my control that 63 percent of American Jews voted for a President whosupports the Muslim Brotherhood, a virulently ant-Semitic and anti-American organization whose motto is:  “Allah is our objective; the Quran is our law, the Prophet is our leader; Jihad is our way; and death for the sake of Allah is the highest of our aspirations ” and a President who appeases Iran.

     Most Americans, including their President,  have no clue that the doctrine of mutually assured destruction MAD  will not work with Iran, but I have heard directly from Bernard Lewis his  “for people with this mindset, M.A.D. is not a constraint; it is an inducement…”and I trust his expertise.

    So you have to trust that we in the Israeli government know what we are doing.  We are fighting for Israel’s very survival and we will prevail.

    Joseph (or anyone else reading this),

    Any guesses as to how the release of prisoners would affect the ability of Israel to deal with Iran? Does Israel believe that the releases give them some legitimacy in dealing with the Iranians? Or it there some secret agreement that, after good faith efforts by Israel, the United States will take care of the Iranian problem?

    Sorry for all the questions but I thought the educated readers here would have some opinions on the above.

    I’ve followed this website religiously but rarely comment. I am writing a paper for my college writing class on Israel and the Palestinian people. Specifically if there will ever be peace between them. There are very smart people here that I know are knowledgeable on the subject. Any advice on where I can start looking for information on this subject? Websites,books, anything will work. This is important to me and I want to create a persuasive or at least an interesting essay.

      I’m sorry to heavily disappoint you, Joe, but a real peace, you know, like between Swiss and France, for example, will never be here. This conflict is deep, this conflict is very old, this conflict is about land and religion, this conflict is about the Jewish People and their place under the stars, this conflict is about Jihad, extremism and killings. This conflict is as older as the religions themselves and only One entity will solve it. And everybody is waiting for Him, because the simple mortal people cannot solve it.

      You see, even the word ‘Palestinian’ is misleading because there never was a Palestinian people or a Palestinian state.
      A very short history:
      – The majority of the Jewish people were expulsed from Israel by the 2nd century AD.
      – The land has been named by the Romans Palestine (after the long extinct people of the Philistines which are in no way related to the ‘Palestinians’).
      – After that there was a strong Greco/Roman presence in the Country (not all the Jews were driven out)
      – Cristianity spread and Israel became part of Byzantium.
      – in the 7th century AD Israel was conquered by Persians and then by Muslim Arabs.
      – The ‘Palestinians’ are either descendends of these invaders or descendends of people who converted to islam.
      – Since then Israel has been ruled by various islamic empires.
      – These people never called themselves ‘Palestinians’ but they called themselves Arabs. They lived quite happily under the rule of islamic empires and never showed any desire to form an independend state nor showed they any sense of an own distinct nationality. They simply identified themselves as Arabs.
      – Allthough they were the majority there were always Jews and other people in the Holy Land.
      – In world war 1 the British liberated the Middle East from the rule of the last islamic empire (the Ottomans).
      – They called the combined territories of modern Israel, Jordan and Gaza Palestine (The British Mandate for Palestine).
      – From this area they gave right away 85% to the Arabs (modern day Jordan).
      – The remaining 15% was to be shared by the state of Israel and the Arabs.
      – Refusing this proposal the Arabs tried to drive the Jews into the sea in several wars.
      – Realizing after the defeat of ’67 that they could not drive the Jews out by force they used a new strategy to delegitimize Israel and to get political support for their cause.
      – They called themselves Palestinians to imply that they were the rightful owners of the land and that they were a tiny little helpless people suppressed by overwhelming Israeli military might.

      That is the origin of the word ‘Palestinian’. In truth there are no Palestinians, Just Arabs.

      Here is a quote from ‘Palestinian’ politician Zouhair Moussein from 1977.

      “The Palestinian people does not exist. The creation of a Palestinian state is only a means for continuing our struggle against the state of Israel for our Arab unity. In reality today there is no difference between Jordanians, Palestinians, Syrians and Lebanese. Only for political and tactical reasons do we speak today about the existence of a Palestinian people, since Arab national interests demand that we posit the existence of a distinct ‘Palestinian people’ to oppose Zionism.”

      If you study the sites I’ve mentioned you’ll see that a peace requires nothing short of a radical reform of islam or a total separation of islam and political power.
